III. Comments - Compliance (Continued) <br /> 7) The Mine #5 drainage ditch along the north side of the lower <br /> bench has been rebuilt. <br /> 8) A berm has been built south of the warehouse between the <br /> storage pad and Dutch Creek. <br /> 9) An overflow pipe has been installed in the artic circle pump <br /> pond since the last inspection. This overflow pipe was running full onto <br /> the ramp/road leading to the pump. The water was running into the artic <br /> circle ponds. This water must be diverted into Dutch Creek. <br /> 10) Several places east of the MSHA trailer at Mine #1 , water had <br /> flowed over the outslope. A berm must be built up east of the MSHA <br /> trailer to direct water away from the outslope. <br /> 11) The oil barrels noted by OSM in a recent inspection to be <br /> improperly stored at Mine #4 and at the Mine #1 methane pump house have <br /> been moved. The hole in the spill prevention barrier around the fuel <br /> tank at Mine #2 has been patched. A ditch leading to the disturbed <br /> drainage culvert has been built from the oil tanks at Mine #2 to contain <br /> any spillage within the sediment control system. <br /> 12) The two upper sediment ponds below the refuse pile are almost <br /> filled with sediment to capacity. These must be cleaned as soon as <br /> possible. <br /> 13) The operator must install the new culvert between ponds 2 and <br /> 3 over Bear Creek to prevent pond 2 from overflowing this winter. This <br /> installation must be completed as soon as possible. <br /> 4.06 Topsoil _ <br /> The topsoil stockpile above the Mine #1 coal stockpile has not been moved <br /> yet. Mr. Bowman requested a two week extension of the compliance <br /> deadline. <br />
