Problems, Recommendations and Compliance Dates <br /> The operator is advised that the following problems have been identified <br /> during inspections and that failure to correct the problems may result in <br /> the Division taking an ENFORCEMENT ACTION pursuant to CRS 1973, as <br /> amended, 34-33-123. (Recommendations and compliance dates are to be <br /> clearly noted. Dates are to be specific, e.g. , January 31 , 1983 and <br /> underlined. ) <br /> 017-83-22 Clean the material tracked onto the access road from the <br /> preparations plant near the front gate by November 21 , 1983. <br /> 017-83-03 Build up a berm along the outside edge of the Mine #4 road <br /> from the powder magazine down by November 21 , 1983. <br /> 017-83-24 Divert the overflow from the artic circle pump pond into Dutch <br /> Creek by November 21 , 1983. <br /> 017-83-25 Build a berm along the edge of the pad east of the MSHA <br /> trailer at Mine #1 by November 21 , 1983. <br /> 017-83-26 Clean the upper two sediment ponds below the refuse pile by <br /> November 21, 1983. <br /> 017-83-27 Install the new pipe between ponds 2 and 3 over Bear Creek <br /> below the refuse pile by November 7, 1983. <br /> Resolution in Progress <br /> 017-83-8 Remove the coal that is beyond the berm on the southwest <br /> corner of the Mine No. 2 coal stockpile as soon as the stockpile is <br /> sufficiently small enough to facilitate removal of the fugitive coal. <br /> 017-83-13 Clean the slurry from the undisturbed area outside the slurry <br /> pond west of the wash plant and rebuild the embankment so a minimum of <br /> one-foot of freeboard above the level of the emergency spillway is <br /> maintained. This work must be completed by November 15, 1983. <br /> 017-83-14 Sediment pond 006 must be cleaned by November 7, 1983 <br /> (compliance deadline extended because of equipment problems)'. <br />
