Archeological studies have been completed to fully document and record the <br />historic sites on CC&V property. <br />Point Seven - Noise <br />As has occurred with current mining operations over the past 14 years, <br />monitoring stations will be established at receptor points. Currently CC&V is <br />establishing baseline noise information. Upon inception of mining operations in <br />the North Cresson mine area, temporary and permanent noise monitoring <br />stations will be established and monitored in accordance with applicable State <br />requirements. <br />Point Eight - Water <br />The application includes all lease agreements for water supply; all water issues <br />are fully addressed in the permit. <br />The design includes engineered structures sufficient to contain twice the 100 <br />year storm event. In 14 years of operation, none of CC&V's water control <br />structures have even partially filled, let alone to the design capacity. The <br />structures are below ground so if they were filled water would flow naturally as <br />would be found in the gulch. There is no increased risk of flooding. <br />Point Nine - Truck Traffic <br />CC&V has made significant strides as part of MLE to reduce as many trucks <br />driving through Cripple Creek on State Highway 67 as possible. It is impossible, <br />however, to redirect all traffic currently using Highway 67 through Cripple Creek, <br />although traffic will be drastically reduced. <br />Point Ten - American Eagles <br />CC&V voluntarily agreed to open certain of its privately held lands in conjunction <br />with Teller County Parks for American Eagles in order to create an additional <br />tourism opportunity for those visiting the area. There has never been a promise <br />to maintain the American Eagles site or access to the site in perpetuity. The <br />agreement with Teller County for leasing the site allows "during the term of this <br />Lease or any extension thereof... Lessor may replace the Property with other <br />property of Lessor that will reasonably and adequately serve the same purpose <br />as the Property..." <br />The original intent of the lease of the American Eagles to Teller County was to <br />allow flexibility in the use of the property, it never was intended in perpetuity. <br />Point Eleven - Mine Closure <br />There is considerable experience throughout the nation on addressing impacts of <br />the closure of a mining operation. CC&V has committed to assisting the <br />community with preparing for those eventual impacts.
