and other improvements to infrastructure have been made to position Victor well <br />upon the eventual closure of the mine. Cripple Creek would be well advised to <br />undertake such planning and improvements. <br />Proposed Mitigation Measures <br />1. As has been explained to Cripple Creek, CC&V has made a commitment to <br />work with a railroad for access to Victor. CC&V does not own all the land on such <br />a corridor, and therefore cannot and will not commit to "provide track and rail and <br />easements." <br />2. CC&V is unclear on how a recreation center would mitigate the supposed <br />impacts of the mining operation to the Cripple Creek economy. If Cripple Creek <br />develops a viable plan for development of a Gold Camp Recreation Center, <br />CC&V will evaluate any request that may be submitted by Cripple Creek against <br />all other received requests for philanthropic assistance. Demanding such a <br />donation is most inappropriate. <br />3. CC&V is working with the STCFG on the historic structures that can be <br />relocated as part of MLE. Certainly Cripple Creek would agree that relocating <br />some of these structures in the vicinity of Victor would help the tourism economy <br />on Victor's side of the mining district, apparently a large concern for Cripple <br />Creek. <br />4. CC&V has submitted a complete reclamation plan to the State of Colorado for <br />review and approval. <br />5. It is hard to imagine why CC&V would donate more land to the City of Cripple <br />Creek when other donations (e.g. Heritage Center and Gold Camp Trail) have <br />only served to impede mining operations. Demanding such a donation is most <br />inappropriate. <br />6. CC&V has submitted a complete reclamation plan to the State of Colorado for <br />review and approval in compliance with Teller County land use regulations. <br />7. CC&V is unaware that Morgan Stanley has fallen. Under current law the State <br />of Colorado has jurisdiction for reclamation bond, and there is no legal <br />requirement for only the establishment of a cash account. <br />8. As noted above, CC&V has made significant strides as part of MLE to reduce <br />as many trucks driving through Cripple Creek on State Highway 67 as possible. <br />However, it is impossible to redirect all truck traffic currently using the State <br />Highway 67 through Cripple Creek. Traffic will be reduced to levels lower than <br />other deliveries in large trucks to the City. Significant funds will be expended on <br />making delivery point improvements.
