The fact that the proposed SerFer Pit is not harmonious with the surrounding <br />neighborhood and will be an undue influence on the area; <br />The property is designated on the Town of Windsor Land Management Map as <br />open space, under which the allowable uses include mineral extraction. It has <br />been determined by the Applicant that the tract of land in question holds sufficient <br />sand and gravel to justify an economically feasible mining operation. There are <br />two other active mines adjacent to the subject property. Per the DRMS <br />application various local, state, and federal agencies were notified of the <br />application. The owner and The Colorado Division of Wildlife are negotiating an <br />agreement regarding a wildlife buffer area. Per the land use code, and with two <br />existing mining operations in the area, the SerFer Pit is harmonious with the <br />adjacent lands. <br />13. The proposed SerFer Pit will be immediately adjacent to the existing River West <br />residential development, and is currently believed to be the closest that a gravel pit has <br />ever been proposed to be located near such a large residential development in the State of <br />Colorado; <br />Although there is no database that contains this information, a brief search <br />revealed other instances of mines located near residential areas. The Town of <br />Windsor Land Management Plan designates the land as open space, which <br />includes mineral extraction as an approved land use. <br />14. The cumulative adverse impact on the residents of the area given the fact that the <br />residents are already subjected to the adverse impacts of the Kyger/Lafarge Pit and the <br />Hall Irwin Pit that are already_in _operation in the immediate area. The residents of the <br />area should not be subjected to further adverse impacted from gravel pits until the two (2) <br />existing pits in the area have been exhausted and properly reclaimed; <br />The property is shown on the Town of Windsor Land Management Map and is <br />designated as open space, of which the allowable uses include mineral extraction. <br />Furthermore, as there are other mines in the vicinity, the proposed mine site is <br />in agreement with surrounding land use. The SerFer Pit has no relationship to <br />either the Kyger/Lafarge Pit or the Hall Irwin Pit; therefore, it cannot regulate <br />when the completion of these mines occurs. <br />15. The proposed SerFer Pit will unreasonably impair the public health, welfare, prosperity <br />and safety of the current and future residents of the area; and <br />It is unclear how the operation will have a detrimental effect on the quality of life, <br />health, or cause a devaluation of personal property through "by-right" activities <br />on privately owned property in the area. <br />Connell Resources, Inc. will adhere to all rules and regulations required of the <br />proposed mining operation. These rules and regulations set forth by various
