The following discussion and attachments are submitted on behalf of our client, Connell
Resources, Inc. in response to your letter dated May 1, 2008 in reference to "SerFer Pit
Construction Materials Regular (112) Operation Reclamation Permit Application #M-2008-006."
The information and discussion below address each comment within the formal objection to the
Permit Application as it was presented by March, Olive & Pharris, LLC:
1. The dust and allergic reactions that will be created;
Connell Resources, Inc. will adhere to the Colorado Department of Public Health
and Environment (CDPH&E) permitting requirements. This includes submitting
an application for a Construction Permit and Air Pollutant Emission Notices
(APEN). A Fugitive Dust Control Plan will be submitted as part of the
Construction Permit and Air Pollutant Emission Notices permit application. A
Particulate Emissions Control Plan is included in the Construction Permit and
describes how the dust and particulate matter will be controlled.
2. The increased noise that will be created;
It is unclear what threshold or expectations to which this objector. is referring.
Connell Resources, Inc. received noise related input from the neighborhood
meetings. During the meetings, the operation was described in detail. The
operation will meet all noise level limits from the town and the county.
Connell Resources, Inc. intends to utilize sound reducing efforts and techniques to
attenuate any noise generated on the site. This includes placing the crusher
generator in an insulated box and locating the crushing operations in the base of
the active portion of the mining pit. Further sound buffering will be provided as a
