Oak Street, Suite 200 <br />Fort Collins, CO 80524-2880 <br />QUL 10 2008 <br />Division of Rdclaination, <br />Mining and Safety <br />RE: Toepke, Cary & Elaine / Connell Resources, Inc. <br />SerFer Pit Construction Materials Regular (112) Operation Reclamation Permit <br />Application #M-2008-006 <br />The following discussion and attachments are submitted on behalf of our client, Connell <br />Resources, Inc. in response to your letter dated May 1, 2008 in reference to "SerFer Pit <br />Construction Materials Regular (112) Operation Reclamation Permit Application #M-2008-006." <br />The information and discussion below address each comment within the formal objection to the <br />Permit Application as it was presented by March, Olive & Pharris, LLC: <br />1. The dust and allergic reactions that will be created; <br />Connell Resources, Inc. will adhere to the Colorado Department of Public Health <br />and Environment (CDPH&E) permitting requirements. This includes submitting <br />an application for a Construction Permit and Air Pollutant Emission Notices <br />(APEN). A Fugitive Dust Control Plan will be submitted as part of the <br />Construction Permit and Air Pollutant Emission Notices permit application. A <br />Particulate Emissions Control Plan is included in the Construction Permit and <br />describes how the dust and particulate matter will be controlled. <br />2. The increased noise that will be created; <br />It is unclear what threshold or expectations to which this objector. is referring. <br />Connell Resources, Inc. received noise related input from the neighborhood <br />meetings. During the meetings, the operation was described in detail. The <br />operation will meet all noise level limits from the town and the county. <br />Connell Resources, Inc. intends to utilize sound reducing efforts and techniques to <br />attenuate any noise generated on the site. This includes placing the crusher <br />generator in an insulated box and locating the crushing operations in the base of <br />the active portion of the mining pit.
