Walter & Patricia Dorlac <br />RE: SerFer Pit Mining Application Comment Response <br />July 3, 2008 <br />Page 4 of 6 <br />Control, and Countermeasure (SPCC) Plan has been submitted with the DRMS <br />application outlining the procedure Connell Resources, Inc. will follow in the <br />unlikely case of a spill. <br />Connell Resources, Inc. will adhere to all noise regulations. <br />4. The town of Windsor has no noise level limits. The Division must set a residential noise <br />level limit that must be enforced by the town of Windsor. If they are unable to enforce <br />said noise, due to equipment or manning, Larimer County should be held accountable of <br />enforcement. Noise monitoring should include crusher, power production, truck braking <br />and backup horn noise. <br />It is unclear what threshold or expectations to which this objector is referring. <br />Connell Resources, Inc. received noise related input from the neighborhood <br />meetings. During the meetings, the operation was described in detail. The <br />operation will meet all noise level limits from the town and the county. However, <br />the operator has no control over the jurisdictional control of these requirements. <br />Connell Resources, Inc. intends to utilize sound reducing efforts and techniques to <br />attenuate any noise generated on the site. This includes placing the crusher <br />generator in an insulated box and locating the crushing operations in the base of <br />the active portion of the mining pit. Further sound buffering will be provided as a <br />result of stockpiling and maximizing the distance between the crushing operation <br />and the residential area immediately south of the proposed operation. <br />5. This mining operation will have a grave effect on already diminished residential home <br />Homes inRiver West have been on the market over 120 days. The Division <br />should limit the permit time to one year for mining and reclamation to decrease the <br />impact on real estate pricing. <br />It is unclear how home values will be directly impacted by any "by-right" <br />activities on privately owned property in the area. <br />Furthermore, according to the DRMS, if an application for a permit is approved <br />by the Board of the Division, the approved permit is for the life of the mining <br />operation and can not have an expiration date. Revocation and forfeiture of the <br />mine may only occur due to an uncorrected violation of the acts, the rules and <br />regulations, or the terms of the approved permit. While there is no limit on the <br />life of a permit approved by the Board, the life of the mine should be <br />approximately four years.
