Walter & Patricia Dorlac <br />RE: SerFer Pit Mining Application Comment Response <br />July 3, 2008 <br />Page 5 of 6 <br />6. The overall process of a mine permit is quite new to us. I would like to have the Division <br />give this process and the time line to us in layman's terms. Any hearings with the <br />Division or other Federal, State and local entities need to be brought to our attention in a <br />timely manner. The comment period I had was only two weeks. I expect a reply from the <br />Division in this same time period. <br />While this question was delivered to the DBMS, in an attempt to assist you, the <br />following information has been provided: <br />The overall process of a mine permit may be found laid out in the Mineral Rules <br />and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials. An outline of what is available in the rules <br />and regulations may be viewed in the index section at the beginning of the rules <br />and regulations. Furthermore, a guide to citizen participation in the 112 <br />reclamation permit application process may be found on the DRMS site: <br />htlp://www.Mining.state.co.us/Forms/I 12processmemo-%2OFinal.pdf <br />In accordance with rule 1.6.2(1)(b), notices (signs) of sufficient size at the <br />location of the proposed mine site were posted notifying the public of the <br />proposed mining operation, these also included the name, address, and phone <br />number of the applicant. An affidavit of the picture showing the posted signs at <br />the site can be viewed in the DRMS permit application. <br />It is required by rule 1.6.2(1)(d) to publish the public notice four times, once a <br />week for four consecutive weeks in a newspaper of general circulation in the <br />locality of the proposed mining operation. <br />A public notice was published in the Windsor Beacon four consecutive wee s.- - - <br />The first publication took place on February 28, 2008 and the final publication <br />took place on March 20, 2008. An affidavit of the publication may be viewed in <br />the DRMS permit application. <br />Furthermore, it is also required in rule 1.6.2(1)(e) that the applicant shall mail or <br />personally serve a copy of the notice immediately after the first publication to all <br />Owners of Record of the surface and mineral rights of the affected land and the <br />owners of record of all land surface within 200 feet of the boundary of the <br />affected lands. A certified letter of notice was mailed by the US Postal Service to <br />the homeowners association immediately after the first publication, after <br />subsequent meetings it was determined letters be sent out to affected individuals <br />as well. The affected Owners of Record of the surface, mineral rights, and land <br />surface owners within 200 feet, including Walter and Patricia Dorlac, were mailed <br />letters at this time. Records show the certified letter of notification was received <br />by Mr. and Mrs. Dorlac on April 17, 2008. An affidavit of the mail receipt may <br />be viewed in the DRMS permit application.
