Applegate
roup,.'nc.
July 3, 2008
Lee B. & Kathleen Worthington
628 Poudre Pl.
Windsor, CO 80550
Ph: (970) 686-5771

JUL 10 2008
bidicion oY Reciamatlon.
Mining and Sz1feBy
RE: Letter of Response
SerFer Pit (112) Reclamation Permit Application #M-2008-006
The following discussion and attachments are submitted on behalf of our client, Connell
Resources, Inc., in response to your letter dated May 1, 2008 in reference to "SerFer Pit (112)
Operation Reclamation Permit Application #M-2008-006." The information and discussion
below address each comment within the formal objection to the caption Permit Application.
Comment 1: The application should be denied in total. The location of the proposed mining
operation is inappropriately close and/or adjacent to previously developed residential areas of
significant population, the Cache la Poudre River, the Poudre River Trail, the Frank State
Wildlife Area, and environmentally sensitive areas. We maintain the proposed operation presents
significant dangers to the health, safety, child welfare, environment, property values, aesthetics,
and quality of life for ourselves and other residents in the area
-It is-unclear whaf specifiic dangers are being posed by this project to the health, safety,-- ---
child welfare, environment, property values, aesthetics and quality of life. More focused
comments will warrant a more detailed response. The mining operation will take place
through "by-right" activities on privately owned property in the area. Among. other
permitting agencies, Connell Resources, Inc. will adhere to the Colorado Department of
Public Health and Environment (CDPH&E) permitting requirements. This includes
submitting an Application for Construction Permit and Air Pollutant Emission Notices
(APEN). The intent of the CDPH&E and'the APEN are to limit pollution in all forms.
These rules and regulations set forth by various divisions within the government of
Colorado are designed to prevent adverse effects on the health, welfare, prosperity and
safety of the current and future residents of the area.
Should this application be approved by the board; and the project move forward as a
whole, the safety codes and protocols of all involved agencies and governments will be
followed stringently by Connell Resources, Inc.
Comment 2, Traffic: The proposed operation would significantly increase commercial traffic
and construction traffic, which is already an issue of serious concern, along CR 13 and Hwy 392.
CR 13 is the only access to the subdivisions of River, West Ridge, West-High Pointe Estates,
1499 West 120th Avenue, Suite 200 (303) 452-6611 0 Fax (303) 452-2759
Denver, Colorado 80234-2759 www.applegbtegroup.com
