River West Homeowners Association
RE: SerFer Pit Letter of Response
July 3, 2008
18. The cumulative adverse impact on the residents of the area given the fact that the
residents are already subjected to the adverse impacts of the Kyger/Lafarge Pit and the
Hall Irwin Pit that are already in operation in the immediate area. The residents of the
area should not be subjected to further adverse impacts from gravel pits until the two (2)
existing pits in the area have been exhausted and properly reclaimed;
The property is shown on the Town of Windsor Land Management Map and is
designated as open space, of which the allowable uses include mineral extraction.
Furthermore, as there are other mines in the vicinity, the proposed SerFer Pit is in
accordance with surrounding land use and land use code. The SerFer Pit has no
relationship to either of the Kyger/Lafarge Pit or the Hall Irwin Pit; therefore, it
cannot regulate when the completion of these mines occurs.
19. The proposed SerFer Pit should not be approved by Division of Reclamation, Mining and
Safety (the "Division") unless and until it has been reviewed and approved by Larimer
County, Weld county, the Town of Windsor, the U.S. army Corps of Engineers, the U.S.
Fish and Wildlife Services, the Colorado Division of wildlife, the Colorado State
Department of Health; Larimer county Health and Environment Department, and the
Weld County Health Department.
The SerFer Pit will obtain approval from all required local, state and federal
agencies as required by law.
If the SerFer Pit permit application is passed by the Board, the applicant will follow all
conditions set forth by DRMS. Conditions placed on the permit are at the sole discretion of
DRMS and are site specific.
If you are satisfied with the above explanation regarding your concerns, please submit a written
withdrawal of your objection to the Division of Reclamation, Mining, and Safety. Should you
have any questions or concerns regarding this response, please feel free to contact our office.
Sincerely,
App?te Gro inc.
Ty-Thompson
Natural Resource Specialist
TAT/ta
cc: John Warren, Connell Resources, Inc.
Peter Hayes, DRMS
AG File #07-122
N:\07122 Connell Resources 392 & CR13\Disciplines (Technical)\N ine Planning\Objector Letters\Non-Party Objectors\River West Homeowners' Association
NonParty Response.doex
I
