e \ . <br />Gonzales, Nov 27,2004, p.3, con't <br />I am personally aggrieved because I own mineral rights <br />with proven ore reserves in the immediate area of the Joker Mill <br />and had planned to run my ore through the Joker Mill at some <br />future time on a toll basis. The premature destruction of the <br />Joker MIll under the false and fraudulent quise of confiscatory <br />authority of the BLM to acquire title to mining property <br />"abandoned" on public lands, was an act of illegal thefts under <br />the direction of Rob Ernst, Geologist, Little Snake Resource Area <br />of BLM(Craig, Colo). The acts or mr. rrnsc. c .LLcfL c..iy =?«G==?i?? <br />with the mining rights granted under a valid placer miming claim <br />owned by the Zimmerman family(23) and are therefore in violation <br />of Federal Regulations and exceed the authority of the BLM. and <br />Mr. Ernst. <br />CONSTITUTIONAL ISSUES: <br />A) A regulatory takings of Joker K111 without compensation <br />(Fifth Amendment of U.S. Constitution plus Colorado State Constitution). <br />B) A governmental takings without due process(Fourteenth Amend- <br />ment to U.S. Constitution. Whatever process occured, the net effect <br />was that the useful mill was destroyed for no substantive public <br />purpose, following unreasonable actions by the ,BLLM, particularly <br />Rob Ernst. <br />C) The taking, in aggregate, amounted to a criminal theft <br />of property valued at $4.61million. <br />D) A criminal conspiracy, in my personal opinion as a mining <br />expert with many years of practical experience in mining and mining <br />law matters, resulted due to the mutiple parties .involved, each of which <br />shares in the financial and criminal .liability for the untimely and <br />unwarranted premature destruction of the Joker Mill and related items.
