1
Gonzales, Nov 27,2004,'!, p.2 con"t
order, and to maintain the buildings and equipment in a safe,
orderly, and minerlike fashion. In August, 1998, I was hired(tr)
to do a brief consulting job at the Joker Mill by Zachery Construction
of San Antonio, TX, who was, at that time in a joint venture
with M&MII. The JV was called Elkhead iv, and planned to mine
ore at the Joker Mine and haul it to Baggs and process it there
in a pilot scale mill to prove up a leaching process developed
by the JV. My consulting work at the Joker was comprised of sampling
198 barrels of concentrates and geological samples stored back
of the Joker Mill at the 1986 shutdown. Orvie and Chuck Zimmerman
moved the barrels inside, while I opened them up and sampled for
any hazardous materials. Most of the barrels were geological samples
that were in deteriorated cloth bags, so were dumped, and the
remaining 98 barrels of valuable table concentrates were sampled
and found to be non-hazardous. The door to the mill was stuck c;en
and Orvie was injured when he fell twenty feet from the loader
bucket to the concrete floor while trying to repair the door.
The Elkhead JV ended in 7999, krhen M&1111 expected to take
61% of the JV profits, with Zachsaj-yfi.nancing everything for 39*.
Papers were provided to i44&Mll in March, 2000, ending the
joint venture formally and deeding the Joker Mill buildings and
equipment to M&MII, indicating "tUM11 would be responsible for
the buildings and equipment, under terms of the underlying raining
lease from the Zimmerman family". The Zimmerman lease provided
that leasee M&MII would maintain the mining permit, mill and buildings
in good order, and that the title to the mill equipment, buildings,
permits, and water wells and water rights would revert to the claim
owner(Zimmerman family) 90 days after termination of the lease.
