-2- <br />May 10, 2008 <br />Concerning the possible asphalt materials production at the site from <br />time to time: <br />Any and all asphalt reject and/or surplus asphalt material resulting <br />from site activities will be reprocessed or removed from the site to be <br />disposed of at an appropriate facility. When such asphalt processing <br />occurs at the site, such reject will be set aside (temporally isolated within <br />an earth berm) for either daily/weekly reprocessing or for final disposal <br />offsite at the end of the specific project requiring the asphalt production at <br />the site. All asphalt residues and affected soil will be removed from the <br />site. <br />6.4.5 Exhibit E - Reclamation Plan <br />(1)(9) As stated above: Any and all asphalt reject and/or surplus asphalt material <br />resulting from site activities will be reprocessed or removed from the site <br />to be disposed of at an appropriate facility. All asphalt residues and <br />affected soil will be removed from the site. No asphalt will be buried as <br />backfill at the site. <br />(f)(ii) The applicant will modify the seed mix (for pasture/upper pond edges) <br />to include Timothy, Basin wild rye and Nebraska sedge at 1.0 PLS/acre for <br />each. Planting methods will be the same for the modified seed mix. <br />Modified seed mix for pasture/upper pond edges will be as follows: <br />Bluebunch Wheatgrass <br />Western wheatgrass <br />Crested Wheatgrass <br />Indian Ricegrass <br />Timothy <br />Basin Wild rye <br />Nebraska sedge <br />5.0 PLS per acre <br />2.9 PLS per acre <br />2.0 PLS per acre <br />1.0 PLS per acre <br />1.0 PLS per acre <br />1.0 PLS per acre <br />1.0 PLS per acre <br />A total of 55.6 PLS will be required for final Gate area 4.0 <br />acres of reclamation. (13.90 PLS/acre) <br />With annual reclamation on pond edges, the current site vegetation species <br />stripped into the stockpiled topsoil will have some regeneration along with <br />the above seed mix for more diversity. <br />The shrubs, trees and wetlands vegetation selected by the landowner will <br />be those recommended in the attached NRCS Code 391 Riparian Forest <br />Buffer Specifications. The specific varieties selected for the pond invert <br />(Zone 1 area) are willows (shrub), Broadleaf cattail, and Nebraska sedge.
