Mr. Jim Herron
( Page 3
\_
of total suspended solids or other pollutants discharged into
ground or surface waters as compared to such discharges that
occurred prior to mining or that would occur if the roadways
and mine portal pads were removed. Since all water originating
in Coal Basin, beyond that absorbed by the shallow topsoil
or retained in underground aquifers, eventually makes its
way into Coal Creek and on to the Crystal River, the total
volume of flows from the permit area will not vary in a way
that adversely affects the ecology,of any surface water or
any existing or .planned use of surface or ground water.
The owners of the surface lands within the permit area are
Mid-Continent Resources, Inc. and the U. S. Forest Service.
This special request by Mid-Continent is offered as proof
that it has "knowingly requested, in writing, as part of the
application, that a variance be granted." The U. S. Forest.
Service request is attached as Attachment No. 1.
The proposed reclamation operations will be conducted in
compliance with the requirements of 4.27.4 as herein de-
scribed. As outlined in Chapter V of this permit applica-
tion, all highwalls in the permit area will be backfilled to
the extent possible with all spoil material available in a
manner which results in a static factor of safety of at
least 1.3 using standard geotechnical analysis. The water-
. shed control of the area within which mining occurs will be
improved by reducing the peak flow from precipitation or
thaw and by reducing the total suspended solids or other
pollutants in the surface water discharge during precipita-
tion or thaw. The total volume of flow shall not be altered
in such a way that adversely affects the ecology of the
surface water on any existing or planned public or private
use of surface or ground water. No land above highwalls
will be disturbed.
Upon receipt of approval of this variance request, the
permit shall be specifically marked as containing a variance
from approximate original contour.
Sincerely,
George E. Wear
Director, Special Projects
GEW:rm
C Enclosure
36
