<br />ADDENDUM TO DEPARTMENT OF THE ARMY PERMIT EVALUATION <br />AND DECISION DOCUMENT <br />DON KEHN CONSTRUCTION INC. <br />199280381, AIviENDMENT 1 <br />WETLAND <br />LARIlvIER COUNTY, COLORADO <br />This document constitutes the evaluation of the amendment request to the individual permit. <br />PROJECT ffiSTORY <br />The applicant has not begun the mitigation activities discussed in the Mitigation Plan on page 5 of the <br />permit. He would like to achieve the mitigation requirements by a different method and has requested <br />a permit amendment to do this. <br />On page 5 of the permit it states that "During Phase I, temporary wetlands will be created in the Phase <br />III and Phase IV areas. Groundwater collected by dewatering the lower Phase I pit will be pumped up <br />to these basins, and the existing wetlands contiguous to them. If this technique proves inadequate, <br />shallow basins will be excavated in the temporary mitigation areas as well. " <br />The applicant proposes to eliminate the pumping by using water that already flows through the Phase III <br />and Phase IV areas in a natural waterway, Duck Creek, which terminates in the Phase I area. This <br />waterway carries water year round and is a reliable source. Use of this water source will eliminate the <br />need to ditch, pipe, and/or pump as discussed in the permit. <br />EVALUATION <br />We have determined that the applicant should be allowed to attempt to create the temporary wetlands <br />using the natural waterway located on the property, rather than by pumping. An interage~y meeting is <br />scheduled for October 1999,_which will allow the applicant three growing seasons to successfully <br />complete the temporary mitigation wetlands. If at that time the wetlands do not appear to be successful, <br />then pumping may be required. The applicant must be in total compliance with the permit in 1999. Any <br />deficiencies in the mitigation requirements are grounds for revocation of the permit until the project is <br />brought into compliance. <br />~a~~ ~ o~~ <br />Prerarer: Sandra E.
