Page 6 of 19 <br />Road could be salvaged as a single unit and mixed and replaced as a mix. WFC <br />stated that they would place suitable Bench 1 subsoil below the mixed topsoil layer to <br />make the entire land better suited for vegetation. A topsoil balance of what is already <br />in stockpiles northwest of 2700 & BB road and what is projected to be salvage will be <br />conducted to find a final topsoil mixed depth. <br />Item 3: Pre Mine Vegetation and Land Use <br />Pre Mine Vegetation and Land Use was discussed for all Land Owners north-west of <br />2700 & BB Road. The Division stated that the start of the evaluation would be 1998. A <br />1998 satellite image was furnished by WFC for partial reference. Reports of Peabody <br />Coal 1988 Vegetation Survey and Jim Irvine's 1998 Survey were examined. Definition <br />by Peabody's 1988 Vegetation Study of what Irrigated Crop (IC) ,Irrigated Pasture <br />(IP}, Irrigated Grass Hay (IH) and Rangeland was examined. It became apparent that <br />the Irrigated Pasture (IP) definition and the areas in which lP was mapped was <br />consistent. The definition of IP provided by Peabody and in such mapped stated: " <br />Irrigated Pasture are composed of a myriad of species, both desirable and <br />undesirable, due to irregular irrigation water application, lack of periodic tillage and <br />pasture renovation, low levels of management, and overuse. Swale, bog, or riparian <br />areas have developed in some areas as a result of irrigation water runoff (irrigation <br />tailwater)." It should be noted that some areas of IP were managed better than others <br />and those areas were taken into consideration. Even thou some parcels of land had <br />questionable management practices, the irrigation water ownership would become the <br />final factor. <br />The 1998 Satellite image and the 1998 Vegetation study documented the Morgans to <br />have 21 acres of alfalfa, 28 acres of agrass-alfalfa field and another 1 acre of IP. <br />The satellite image showed a large field north of Frank Morgans house as being <br />irrigated to some degree. This would be pre pipeline construction. <br />Benson West, or the land north-west of 2700 & BB Road intersection indicated <br />
