Page 7 of 19 <br />sporadic irrigation practices and low level of vegetation management. <br />Lloyd Property showed very sporadic irrigation. Shrubs, bushes and rocky outcrops <br />could easily be identified. All of this was consistent with the Peabody definition of IP. <br />James Johnson/WFC land had several parcels that were irrigated to some degree. It <br />would not be determined to what level of management the fields were worked. <br />As stated above, the CCC water shares owned or leased for each land owner would <br />become the prime factor in the Post Mine Vegetation or Land Use. <br />Item 4: Irriaation Water Ownership or Lease Agreement vs Post Mine Land Use <br />A map was presented by Greg Lewicki and Associates along with WFC showing the <br />CCC irrigation water share ownership/lease for the irrigated fields with in the permit <br />boundary. The map showed: <br />1. Morgans leased 50 shares to WFC for reclamation of their land. <br />2. Bud Benson has only 44 shares of water in which all 44 shares are <br />committed to two separate fields east of 2700 Road and are currently <br />under reclamation bond. There is no further water owned by Mr. <br />Benson that could be dedicated to his land north-west of 2700 & BB <br />Road. <br />3. Lloyd Family has 24 shares of CCC water that is dedicated to their land. <br />4. The former James Johnson property only came with 12 shares of water <br />to W FC. <br />5. WFC/Garvey property south-east of the intersection has 24 <br />shares. It should have more. <br />6. Ward Burbridge has 55 shares. <br />7. San Miguel Power has zero shares but has 3.01 CFS decree out of <br />Calamity Draw plus a pump station. <br />
