If COMPANY is .unable to observe CONTRACTOR'S Work, <br />due to conditions, which in the opinion of COMPANY are, unsafe, COMPANY's <br />payment for such Work maybe withheld until Work has been determined to be in <br />compliance with the Contract Documents. <br />F. CONTRACTOR shall be responsible for safety of equipment crossing and traveling <br />along public roads. Construction materials for the dam construction will be hauled by <br />CONTRACTOR along Hwy 133, Minnesota River Road and USDA Forest Service <br />Road 711. <br />1. CONTRACTOR shall provide all temporary and permanent warning signs as <br />required, in accordance with Laws and Regulations. <br />2. CONTRACTOR, at a minimum, shall provide two flag persons at each USDA <br />Forest Service Road 711 crossing, at all times during haulage periods to control <br />the traffic flow. Flag persons shall control County Road 711 public traffic to yield <br />when construction equipment is crossing the roadways, allowing the haulage <br />equipment to have the right-of--way. Spillage on the highway shall be cleaned up <br />immediately. Failure to use the public roads in a safe, clean, manner shall result <br />in a financial penalty to CONTRACTOR and will be deducted from normal <br />progress payments. After COMPANY or COMPANY'S representative has given <br />two verbal warnings of safety violations, subsequent incidents of violation will <br />result in CONTRACTOR being fined $15,000 per incident, deducted from <br />progress payments. Violations will be considered: <br />a. Failure to have competent flag person(s) at an active crossing during haulage; <br />b. Failure to immediately clean-up spillage; <br />' c. Failure to yield public traffic, i.e. "close calls"; <br />d. Repeated complaints from the County Highway Department. <br />' e. Repeated complaints from the USDA Forest Service. <br />3. Use of any other public road for construction haulage must be approved by <br />COMPANY and be in accordance with Laws and Regulations. Any required <br />permits for public road use are CONTRACTOR'S responsibility. <br />' G. Use of explosives, or blasting of any kind shall not be allowed on site or in the vicinity <br />of the site. <br />' H. Burning shall not be allowed unless authorized by COMPANY and in accordance with <br />Laws and Regulations. <br />' 1.04 CONTROLLED SUBSTANCE <br />A. Alcoholic beverages, drugs, or personnel under their influence are not allowed on the <br />' construction site. Any CONTRACTOR's employee in violation of this policy will be <br />permanently barred from the property. <br />01501-2 <br />
