Resources Conservation Service Grand Junction Field Office (MRCS), Colorado Dept. of Health Water <br />Quality Control Division, Colorado Historical Society/HistoricPreseryation Officer (SHPO), U.S. Fish <br />and Wildlife Service, Mesa County Commissioners, Mesa County Planning Department, Associated <br />Governments of Northwest Colorado, the Colorado Natural Heritage Program, and the Colorado River <br />Conservation District. <br />May 22, 2007-DBMS received a comment letter from SHPO indicating that approval of the renewal <br />application would not affect cultural resources. On the same date, the Division received verbal <br />confirmation from Carl Johnston of OSM, indicating that no Biological Assessment would be required <br />for the Munger Canyon Mine renewal, because a Biological Assessment and Biological Opinion <br />completed in 2006 in association with permit renewal for the adjacent McClane Canyon Mine also <br />addressed the Munger Canyon Mine <br />July 11, 2007--The Division's Preliminary Adequacy Review letter (PAR) was sent to CAM. The <br />letter requested the operator to submit numerous updates to the permit application package, to replace <br />outdated plans and documentation, and to more accurately represent the current status of the operation. <br />In addition to the status updates, which the Division indicated could be submitted and incorporated into <br />the permit in the context of the renewal application, the letter requested (in Item No. 4 of the PAR), <br />submittal of a separate technical revision application that would contain "as-built" reclamation contours <br />and specifications pertinent to the reclamation grading operations completed in the summer of 2007. <br />August 8, 2007-The Division's RN-OS Reclamation Cost Update was completed and sent to the <br />operator. The estimated liability calculated by the Division was $239,652.00, which represented an <br />increase of $13,303.00 over the previous liability amount, and an increase of $9,652.00 over the bond <br />amount held ($230,000.00). <br />August 15, 2007-The Division received a letter from the operator dated August 13, 2007, addressing <br />concerns with certain task assumptions included in the Division's reclamation cost estimate <br />documentation. <br />September 7, 2007-The Division received the operator's letter of the same date, presenting itemized <br />responses to the PAR letter, with associated replacement permit text, tables, and appendices. The <br />response to Item No. 4 of the PAR, was that the requested technical revision application would be <br />submitted by November 30, 2007. The requested application (Technical Revision No. 23) was received <br />by the Division on October 5, 2007, and deemed complete on October 9, 2007; a proposed decision on <br />TR-23 had not been issued as of December 13, 2007. <br />September 17, 2007-The Division received an updated page M(viii)-1 iv from the operator, under <br />cover letter dated September 14, 2007. The drawing depicted modified silt fence and permanent <br />channel "berm-break" locations on the reclaimed mine bench area. <br />October 9, 2007-The Division issued its 2"d adequacy review letter to the operator. The letter <br />requested certain additional updates to revised "Identification of Interests" and "Compliance <br />Information" sections of the application.
