III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during the <br /> inspection and the facts or evidence supporting the enforcement action. <br /> Main Mine Site <br /> No problems were observed at the utility bench. The back ditch and the bench's outside berm <br /> were in place. The material storage area was orderly. The rock catchment berm above the utility <br /> bench was functional. The slide just below the utility bench appears to have stabilized. The <br /> operator stated that an engineer has looked at the slide and remedial operations will begin very <br /> soon. "rhe road to the utility bench was in good condition. <br /> There was a moderate amount of coal stockpiled on the D-seam portal bench. No problems with <br /> fugitive dust were observed. There were no problems with any of the facilities on this bench, <br /> including the fuel barn. Ditches had sufficient capacity. There were no problems with the <br /> highwall or the cut slope behind the warehouse. <br /> No problems were observed with the structures or ditches at the B-seam portal bench. There <br /> were no erosional or stability problems at the B-seam portal bench excess material stockpile <br /> area. Cross drains on top of the stockpile were in place. <br /> The vegetative cover at the main topsoil stockpile was very good. Topsoil signs were up. <br /> There was a moderate amount of stockpiled coal on the coal stockpile bench. There were no <br /> indications of fugitive dust going offsite or of coal dust being tracked onto the main highway. The <br /> ditches and culverts around the main entrance were functional. There was a little standing water <br /> in sediment pond B. The pond was not discharging. The pond embankment was stable and the <br /> spillways were functional. <br /> No problems were noted at the wash plant area. The culverts and ditches were functional. The <br /> highwall was stable. Surface disturbance markers were up around the site and the mine ID sign <br /> was up at the mine entrance. <br /> Coal Waste Disposal Site <br /> The gob pile haul road was in very good condition. The outside berm of the haul road, road <br /> ditches and the road ditch straw bales were in place. Pond D was almost dry while pond C had <br /> some water in it, but was not discharging. Pond F had a little water in it. The discharge <br /> structures of the ponds were operational. <br /> The operator was placing coal waste in the gob pile area between gob pile no. 1 and gob pile <br /> no. 2. Above this area, the operator was excavating soil to increase future gob storage area and <br /> to provide cover material for the gob. The gob pile area had positive drainage. The lower <br /> sections of the gob pile were already covered with soil material. The gob pile outslopes were <br /> stable. <br /> Field Minor Revision No. 84 <br /> Field Minor Revision No. 84 was approved so that Bowie Resources could take the topsoil-like <br /> material that was originally salvaged from the Hubbard Creek vent shaft construction site and <br /> stockpile it at the Bowie No. 2 unit train loadout topsoil stockpile. The topsoil-like material can <br /> come from the Paonia Water Pollution Control Facility or directly from the Hubbard Creek vent <br /> shaft construction site. <br /> 2 <br />
