IV. ENFORCEMENT ACTIONS <br /> The following identifies enforcement actions taken during this inspection, the required abatement <br /> and date of abatement for the violation, previous violations still requiring abatement and the <br /> termination of violations cited during previous inspections. <br /> Notice of Violation CV-2007-06 was issued for failure to confine surface coal mining and <br /> reclamation operations to lands within the permit area. Topsoil-like material and excess rock <br /> were transported from the Hubbard Creek vent shaft construction site to the Paonia Water <br /> Pollution Control Facility, which is not the approved plan. The topsoil-like material should have <br /> been stockpiled within the Bowie No. 2 permit area and the excess rock should have been <br /> transported to the Bowie No. 1 East Mine for permanent storage as approved in MR-83 for <br /> Bowie No. 2 and MR-119 for Bowie No. 1. The two abatement steps are: <br /> 1. Transport topsoil-like material from the Paonia Water Pollution Control Facility to the Hubbard <br /> Creek vent shaft construction site for storage or to another topsoil storage area approved by the <br /> Division through a minor revision. Field Minor Revision No. 84 was approved so that the topsoil- <br /> like material from the Paonia facility or from the Hubbard Creek vent shaft construction site can <br /> be stockpiled at the Bowie No. 2 unit train loadout main topsoil stockpile. The due date for <br /> abatement is 5 pm on November 23, 2007. <br /> 2. Transport excess rock to the Bowie No. 1 Mine as approved in Minor Revision No. 83 or <br /> obtain Division approval through a technical revision to keep the excess rock at the Paonia <br /> facility.
