III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during the <br /> inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear <br /> represented the operator, Bowie Resources LLC. <br /> Hubbard Creek Vent Shaft Site <br /> The operator continues to construct the vent shaft pad. The operator has encountered a lot of <br /> rock in the excavation process and was running out of room to put all of the materials. Bowie <br /> received approval in Minor Revision No. 82 to store the excess rock in a temporary rock storage <br /> area near the intersection of the Hubbard Creek road and the Freeman Gulch road. Through two <br /> minor revisions, MR-83 for Bowie No. 2 and MR-119 for Bowie No. 1, Bowie Resources received <br /> approval to place up to 3,000 cubic yards of rock from this project at the Bowie No. 1 East Mine. <br /> However, it was discovered during this inspection that only some of the excess rock had been <br /> trucked to the Bowie No. 1 Mine, as was the approved plan. Most of the excess rock had been <br /> trucked off the permit area to the City of Paonia Water Pollution Control Facility. The city was <br /> going to use the material to fill in old sewage ponds. This location was not approved by the <br /> Division for storage of the excess rock. <br /> It was further discovered during this inspection that a topsoil-like material had been excavated <br /> from the Hubbard Creek vent shaft site and was being transported to the City of Paonia Water <br /> Pollution Control Facility as well. The topsoil-like material was somewhat dark in color, did not <br /> have an excessive amount of clay content and appeared to be able to support plant life. There <br /> was a separate topsoil stockpile at the Hubbard Creek shaft site <br /> A site visit to the City of Paonia Water Pollution Control Facility showed that the excess rock and <br /> topsoil-like material had been stockpiled next to other soil material just outside of the facility. <br /> About 250 cubic yards of topsoil-like material were stockpiled on the west side of the pile with <br /> the excess rock and associated dirt extending behind the topsoil-like material to the east. <br /> Since the excess rock had been transported to a storage site not approved by the Division and <br /> because topsoil-like soil had not been stockpiled within the permit area, Notice of Violation CV- <br /> 2007-06 was issued. <br /> mmWM <br /> Topsoil-Like Material Remaining Topsoil-Like Material (Dark Colored) <br /> at Hubbard Creek Vent Shaft Site and Excess Rock (Behind Topsoil) <br /> Transported to the Paonia Facility <br /> 1 <br />
