January 29, 2002 <br />Page 3 of 4 Pages <br />There report states that waste coal materials were placed and compacted in general accordance with <br />the project plans and specifications. <br />4`h Quarter 2000 <br />The inspection was conducted on December 18, 2000 and submitted to Twentymile Coal Company <br />on February 1, 2001. It was received at the Division on February 6, 2000. Thus the requirement to <br />provide to the Division the report with 2 weeks after the inspection was not met. There report states <br />that waste coal materials were placed, and appeazed to have been placed, in general accordance with <br />the project plans and specifications. The report does not include a description of (or lack of) any <br />appearances of instability, structural weakness, and other hazardous conditions observed during the <br />inspection. <br />Rule 4.09.1(11)(c) See the Rules for the text of this rule. The reports are, by exception, in <br />compliance with this rule. The certified reports do not address the underdrain system and protective <br />filters. <br />Rule 4.10.2(2)(a) Inspection shall occur at least quarterly, beginning within 7 days after the <br />preparation of the disposal area begins. The Division may require more frequent inspection based <br />upon an evaluation of the potential danger to the health or safety of the public and the potential <br />harm to land, air and water resources. Inspections may terminate when the coal mine waste bank <br />has been graded, covered in accordance with 4.10.4(4), topsoil has been distributed on the bank in <br />accordance with 4.06.4, and revegetated, or at such a later time as the Division may require <br />All of the inspections were quarterly inspections. <br />Rule 4.10.2(2)(b) Inspections shall include such observations and tests as may be necessary to <br />evaluate the potential hazard to human life and property, to ensure that all organic material and <br />topsoil have been removed and that proper construction and maintenance are occurring in <br />accordance with the plan submitted under 2.05.3(8) and approved by the Division. <br />Measurements of groundwater elevations in wells aze reported in all three of the quarterly reports. <br />These are observations that may be necessary to evaluate the potential hazard to human life and <br />property. There was no removal of organic or topsoil mentioned. <br />ls` Quarter 2000 <br />No constmction had been accomplished on the waste pile. Stockpiling of approximately 21,000 tons <br />of waste coal at the site was reported. As no lifts were placed, no inspection for proper constrrction <br />was accomplished. There is no mention of maintenance. <br />3`d Quarter 2000 <br />Proper construction was reported in this report. Surface drainage (maintenance) was reported as <br />greatly improved. Compaction tests were made and results reported. <br />
