Approximately all of the area shown as Phase I on the
original plat has been crushed out. It is presently used
for stockpiles of various types , and the crusher is located
as shown in this area on the revised plat which accompanies
this report. The operator proposes to start up a concrete
batch plant in Phase I at the location shown on the revised
plat. Eagle County has been notified of this proposal and
has not objected to such a use under the present Special Use
Permit.
The area shown as Phase II on the original plat (the
easterly end of the permitted area) has been pressed into
service as a stockpile area for various types of aggregate.
It is likely that only a small part of this area will ever
be mined, and that would be the final phase of the mining
operation.
The area which is shown as Phase III on the original
plat is in fact the area currently being worked. This move
into Phase III instead of Phase II is in part an effort to
pacify Chester Goldman, of the Brush Creek and Eagle River
Trust, who continues to object to the mining operation at
every opportunity. Mr. Goldman finds operations on the
western end of the pit area less irritating. A portion of
the easterly end of Phase III has in fact been mined out ,
and this area is shown as "Excavated Area" on the revised
plat. It is approximately three acres . The area west of
the excavated area has been stripped of topsoil and exca-
vation is presently going on there. The area is disturbed
-2-
