NS&G hereby commits as a term and condition of its <br /> permit application that the settling ponds located in the <br /> permit area will be operated at all times as a no-discharge <br /> system such that there will be not be any discharge of water <br /> into the irrigation ditch or other surface waters. <br /> 5. A small catchment pond will be constructed by the <br /> concrete batch plant operator in order to prevent any possi- <br /> bility of soil and water contamination. In addition, NS&G <br /> commits that any contaminating material not appropriately <br /> handled by the catchment pond will be transferred to the <br /> county land dump or otherwise properly disposed of. <br /> 6. NS&G understands and agrees to the standard water <br /> quantity stipulation upon issuance of its permit , such that <br /> NS&G will at all times comply with all applicable state water <br /> quantity laws . <br /> IV. Exhibit E - Reclamation Plan. <br /> 1 . NS&G has determined that certain modifications of <br /> the reclamation plan as developed by Land Design Partnership <br /> are necessary and desirable in order to enhance the possibil- <br /> ity of achieving reclamation success. Specifically, NS&G pro- <br /> poses that no seedlings be planted as part of the reclamation <br /> plan based upon the advice of the local representative of the <br /> Soils Conservation Service that any such seedlings have no <br /> chance of survival given the conditions of the permit area. <br /> With regard to terracing at 10-foot vertical intervals on the <br /> north facing slope, NS&G will instead create a gentle 2 : 1 <br /> slope , that will be stable and capable of supporting permanent <br /> vegetative cover. This method of regrading is preferable to <br /> terracing because terraces will be more subject to sloughing <br /> through water accumulation. Moreover, the primary purpose for <br /> the terraces was to allow planting for seedlings and this <br /> objective is obviated by deletion of the seedling proposal . <br /> The seed mixture to be used for the permit area will be that <br /> which NS&G determines to be most successful based upon use of <br /> the mixture proposed by Land Design Partnership in alternation <br /> with use of the mixture proposed by the Soil Conservation Ser- <br /> vice, as set forth in its permit amendment application. NS&G <br /> has determined from prior experience that use of drill seeding <br /> does not substantially enhance the prospects of revegetation <br /> success and thus proposes to use broadcast seeding only. NS&G <br /> commits to apply mulch at the rate set forth in the Land <br /> Design Partnership proposal and will also employ fertilizer, <br />
