Ms. Carol Russell
June 14 , 1984
Page two
that it possesses a formal easement over this road. Accord-
ingly, NS&G agrees to include in the permit area that extent
of the access road which commences at the right angle turn
and then bearing to the west from the access main road.
Revised maps showing this inclusion will be submitted as soon
as possible and in no event later than 30 days after permit
approval. On the other hand, the road shown on the western
end of the property and denominated as a "50-foot road
easement" will not be used by NS&G as a mining access road .
Rather , that road easement represents a potential future
access for cattle to traverse the area. Accordingly, NS&G
does not propose to permit that easement as an access road .
III . Exhibit D - Mining Plan.
1 . NS&G agrees to maintain a 100-foot buffer zone for
the Eagle River with respect to all mining operations other
than access traffic. Specifically, the only point at which
the Eagle Pit permit boundaries are located closer than 100
feet to the Eagle River is along a short stretch at the far
eastern end of the permit area. NS&G agrees to conduct no
gravel extraction activities within this area. The access
road to the Eagle Pit is located within this area, however,
and NS&G proposes that the only activity to occur within this
stretch of the permit would entail the passage of trucks and
other mining equipment in order to obtain access to the permit
area together with the short term stockpiling of sand.
2. ( a) The local representative of the Soil Conservation
Service has agreed to prepare a detailed site specific soil
report which shows the depth of salvagable topsoil at specific
locations throughout the permit area . As a result of time
conflicts, however, such soils report will not be available
until on or about June 20 , 1984 , at which time it will be
provided immediately to the Division.
( b) All available topsoil in the permit and amendment
area will be salvaged based upon the professional advice of
the Soil Conservation Service regarding the extent of salvag-
able topsoil .
( c) The approximate volume of the topsoil to be sal-
vaged is approximately 17 ,600 cubic yards and the volume of
the existing topsoil stockpile is approximately 2,300 cubic
yards.
3. The elevation of the Stremme and Gates Ditch at the
eastern terminus of the permit area is approximately 6 ,440
