No more than 50 acres of the mine and reclamation area can be <br />disturbed at any one time. <br />Southdown cannot reduce the area of impact for the current reclamation plan in the permit <br />application. In order to achieve the goals of the reclamation plan, the 82-acre average <br />disturbance and 115 acre upper limit of disturbance are necessary requests. The 115-acre azea <br />of disturbance is reached from year 10 to year 16 because of complex cross-pit reclamation <br />topography. <br />Reduction of impact will be possible for the conceptual prairie reclamation plan, and Southdown <br />will quantify this area of impact as soon as possible. In any event, a minimum of 45 acres is <br />required for mining alone and even with the prairie reclamation plan we anticipate about 80 to <br />85 acres would be disturbed at any given time. The prairie reclamation plan provides fewer <br />total acres of disturbance and has much greater setbacks from the property lines, allowing a <br />larger buffer azound the mine. <br />STAFF COMMENT 12. This permit shall be reviewed by the Board of County <br />Commissioners on a 5-year basis. This public forum is intended to generally review the <br />project and address any issues, concerns, or regulatory changes which could occur after the <br />operation begins. <br />Southdown agrees to five-year reviews that focus on regulatory compliance, based upon specific <br />performance standards established in the original permit. Southdown will not agree to a process <br />that, in essence, repermits the entire operation every five years, as it is not possible to plan and <br />invest in a long term mine and reclamation operation under this scenario. Southdown will agree <br />to a review based upon changed circumstances or new conditions if these issues are 1) <br />specifically tied to the monitoring and management plans, and 2) terms and conditions of the <br />original permit approval. <br />B. COUNTY ROAD 47 VACATION/RELOCATION, Docket V-93-8: Approval with the <br />following conditions: <br />STAFF COMMENT 1. Applicant shall deed to the County an exclusive access easement <br />on the section of North 55th Street adjacent to Rabbit Mountain Open Space (from the <br />Rabbit Mountain Parking Lot/Trailhead across the NCWCD Supply Canal and <br />approximately 1/2 mile south) specifically for the maintenance and management of County <br />property. The County is willing to grant an access easement to the applicant over the same <br />length of vacated roadway for mine operations. These actions will require the installation <br />of a gate along this roadway to prevent public access; this gate should be installed by the <br />applicant to the standards of the Northern Water Conservancy District and County Parks <br />and Opeo Space. <br />L, A G R A <br />Earth & Environmen re/Group <br />
