4 <br /> across the dominant estate to the Eagle River for the installation and <br /> maintenance of a pipe for the transportation of water; provided that Grantee's <br /> use of this easement shall not unreasonably or unnecessarily interfere with <br /> the Grantor's use and enjoyment of and access to the dominant estate. This <br /> easement shall be 50 feet in width, all within Tract 51 and the dominant <br /> estate, and described more particularly as follows: <br /> Beginning at a point on the Northerly boundary line of the <br /> servient estate from which the closing corner at this <br /> intersection of the Northerly line of Tract 52 and the line <br /> common to Sections 2 and 3 bears N. 26°07'11" W. 2218.63 feet <br /> distant; thence along the Northerly boundary line of the <br /> servient estate N. 87°52'06" E. 50 feet; thence N. 02°07 '54" W. <br /> approximately 100 feet to the Southerly bank of the Eagle River; <br /> thence along the Southerly bank of the Eagle River S. 87°52'06" <br /> W. 50 feet; thence S. 02007'54" E. to the point of beginning. <br /> This easement shall be for the limited purpose of discharging water from the <br /> servient estate into the Eagle River, after said water has been used in the <br /> mining and preparation of gravel. This easement shall be deemed abandoned at <br /> the time Grantee shall have abandoned the active mining and preparation of <br /> gravel mined on the servient estate for three successive years. <br /> -2- <br />
