EXHIBIT C <br /> EASEMENTS <br /> As used in this Exhibit C, the term "servient estate" shall refer <br /> to the property described in Exhibit A attached to the General Warranty Deed <br /> and by reference made part hereof; the term "dominant estate" shall refer to <br /> the property described in Exhibit D attached to the General Warranty Deed and <br /> by this reference made part hereof; the term "Grantor" shall refer to The <br /> Brush Creek 6 Eagle River Company; and the term "Grantee" shall refer to <br /> Nottingham Sand and Gravel Company, as stated in the General Warranty Deed. <br /> A <br /> Grantor reserves an easement in perpetuity to move livestock across <br /> the servient estate, to and from the dominant estate; provided that Grantor <br /> shall not unnecessarily interfere with Grantee's use and enjoyment of the <br /> Property, and provided that Grantor shall hold Grantee harmless from any <br /> and all damage or liability which livestock crossing the servient estate <br /> under this easement shall cause. <br /> B <br /> Grantor reserves an easement in perpetuity for ingress and egress, <br /> including but not limited to vehicular ingress and egress, as set forth in <br /> Exhibit A. Grantor reserves the right to reconstruct or construct a road <br /> within this easement. This easement may be jointly used by Grantor and <br /> Grantee, and if jointly used, shall be jointly maintained; but if used <br /> exclusively by one of the parties for a period of a year or years, it shall be <br /> the using party's obligation during said period to maintain this easement. <br /> Grantor further reserves the right, at grantor's sole expense, to <br /> construct and maintain within this easement pipes and lines for utilities, <br /> including but not limited to electric power and telephone lines, provided <br /> that Grantor shall not unreasonably or unecessarily interfere with Grantee's <br /> use and enjoyment of the servient estate. <br /> C <br /> Grantor grants to Grantee an easement on the dominant estate 25 feet <br /> in width along the common boundary of the dominant and servient estates. This <br /> easement shall be for the purpose of establishing and maintaining pumping <br /> stations to pump water from the easement to the servient estate. Said <br /> easement shall permit the Grantee to operate up to three sump pump stations <br /> within the easement, and shall permit power lines, pipes for the transportation <br /> of water and any other necessary access for the installation and maintenance of <br /> said sump pump stations; provided Grantee shall not unreasonably or <br /> unnecessarily interfere with Grantor's use and enjoyment of the dominant estate, <br /> and provided said power lines, water pipes and sump pump stations shall, to <br /> the extent it is reasonably feasible, be kept concealed or camouflaged. <br /> Enjoyment of this easement shall, in addition, require that the Grantee not <br /> discharge or permit the discharge of any water taken under this easement <br /> directly upon the dominant estate without Grantor's permission. Water removed <br /> under this easement shall be limited to use on the servient estate by the <br /> Grantee for any rightful purpose. Neither this contract nor this easement <br /> conveys any right, title or interest in water. This easement shall be deemed <br /> abandoned if Grantee shall fail to actively operate and maintain sump pump <br /> stations for use in the extraction or preparation of gravel for three <br /> successive years. <br /> D <br /> Grantor grants to Grantee an easement from the servient estate <br />
