<br />' Ll). A statement of the professional qualifications of the certifvine professional.
<br />Mr. Walker was graduated from the Colorado School of Mines with a Professional Degree in Geological
<br />' Engineering in 1959, and from the Missouri School of Mines at Rolla with a Bachelor of Science Degree
<br />Equivalent in Civil Engineering in 1964 and a Master of Science Degree in Civil Engineering (major in Soils
<br />Engineering) in 1966. His pertinent experience includes construction of drainages, structures, impoundments
<br />for dredge spoils, and erosion control and wildlife water dams and ponds; teaching [earthwork (including
<br />' hydrology and drainage) design, methods of construction, construction management, and quality control
<br />(including soil material testing)]; review and management of design and construction of dredge spoil
<br />containment structures (impoundments); and inspection of sedimentation darns for safety, stability, and
<br />' operational effectiveness. He is a registered Professional Engineer in the States of Colorado and Missouri.

<br />' The requirement for this certification is Rule Number 4, Section 4.05.9 (10) and (11) of the Regulations of
<br />the Colorado Mined Land Reclamation Board for Coal Mining.
<br />' f~ A specific description of the subject of the certification.
<br />The subject of this certification is sedimentation Pond Number 003 in Permit Number C-81-012, and concerns
<br />' items (a) through (e) presented above. it is an earth embankment structure. Appurtenant structural elemenu
<br />include a riprap-lined earth emergency spillway and a primary spillway [corrugated metal pipe (CMP) trickle
<br />tube provided with a metal baffle plate]. The permit is [o conduct a mining operation known as the Chimney
<br />' Rock Mine for the purpose of extracting coal, and was issued to Kaiser Steel Resources (now Kaiser Ventures,
<br />Inc.). The Chimney Rock Mine (including the subject pond) is located in Archuleta County, State of
<br />Colorado, in Township 34 North, Range 4 West, New Mexico Prime Meridian, approximately 22 miles
<br />southwest of Pagosa Springs, Colorado.

<br />This certification does not extend to verification that the information in the Sedimentation Pond As-Built, and
<br />other information found in Exhibit 7, represents existing conditions in [he field, nor that the structure was
<br />' designed, built, or operated in compliance with Rules 4.05.2 through 4.05.9 of Colorado Mined Land
<br />Reclamation Division.
