<br />Banks and Gesso, LLC <br />post-mining land used would be water storage and wildlife habitat. <br />Appendix 6 contains the mining and reclamation permit application that <br />has been submitted to the Division of Minerals and Geology (DMG). <br />Appendix 6 also contains a letter from the DMG indicating that they would <br />include the remedial plan in their permit. <br />' Ground water use on site (for the uses that ASCI is proposing) is <br />controlled by both the Division of Minerals and Geology (pursuant to their <br />' governing statutes and regulations) and by the Colorado Division of Water <br />Resources (pursuant to their governing statutes and regulations). A <br />Temporary Substitute Supply Plan and gravel pit well permit application <br />' has been submitted to the State Engineers Office pursuant to their <br />requirements for this type of mining operation. <br />t 3.7 Nature and Extent of Contamination <br />Appendix 3 contains an Environmental Sampling Report prepared by <br />' Grant Environmental, Inc. Ten additional surface soil samples were <br />collected and sent to the laboratory on June 16, 2000 for additional <br />analysis of organochlorine pesticides. The results of this testing are <br />' included in Appendix 8. <br />o~ ~t °.;~ <br />4.0 Applicable Standards ;:'~~d" <br />This VCUP focuses on the clean up of toxaphene contaminated soils. The <br />Colorado Department of Transportation (CDOT) recently had a similar situation in <br />' Sterling, Colorado and CDPHE agreed on the following clean-up standards <br />(which ASCI is proposing here): <br />' Clean Closure (unrestricted use) - 0.40 mg/kg <br />Solid Waste - >0.40 mg/kg but < 40 mg/kg <br />Hazardous Waste - >40 mg/kg <br />' 5.0 Voluntary Clean Up Proposal <br />' 5.1 Description of Remedial Plan <br />' Soils containing toxaphene concentrations above 40 mg/kg will be <br />excavated by shovel or loader and placed directly into trucks for <br />immediate off-site transport to an approved disposal facility (ASCI plans <br />' on using it's own personnel and equipment for this work). No facility <br />has been chosen yet but options include; <br />' Clean Harbors -Kimball, Nebraska <br />Safety Kleen -Grassy Mountain, Utah <br />HLA/Waste Management -Lake Charles, Louisiana <br />1 <br />Asphalt Specialties Co., Inc. -Pesticide 5 99048.WD <br />' Voluntary Clean Up Plan Application July 2000 <br />
