_ ~ ~ ~ 1.6(I) <br />(iv) There are personnel at the site but they are <br />engaged in acttvities which are not significantly moving the <br />site towards completion of the mining operation. The Board <br />wil.i judge these acttvities in relation to the size of the <br />operation, the nature of the ore body and other facts. <br />(v) There is no sale or processing of material <br />or movement of stockpiled material. <br />(vi) There 15 only minima) or token excavation of <br />mineral or other material. <br />(vii) Mine development has ceased and mining has <br />not commenced. <br />(b) Amine is not in temporary cessation if <br />(i) Extraction of minerals has been completed <br />and only final reclamation and related activities are <br />occurring at the site (see CRS, 34-32-103(6)(b) and Rule 1.65). <br />(i1) A permit has been issued but the mining <br />operation has not commenced. <br />(c) There may be temporary cessation for part of the <br />mining operation when one or more operations of several <br />separable types within a permit has been discontinued. <br />Movement of portable equipment between permitted s7tes shall <br />not be construed to be temporary cessation. <br />(2) The Operator, Division and Board shalt utilize the <br />following procedures in filing a Notice Of Temporary Cessation <br />and making decisions thereon. <br />(a) The operator shall submit, in writing, to the <br />Division, a Notice Of Temporary Cessation as required 1n Rule <br />1.62. The Notice shall state the date of cessation, the <br />reasons therefore, a plan for resumption of mining, and the <br />measures to be taken to comply with reclamation requirements <br />and/or other site maintenance acttvities related to the <br />performance standards of Rule 6 while the mine 1s in temporary <br />cessation. The Notice shall be separate from any other <br />correspondence or reports submitted to the Division. <br />(b) The Division will place the Notice of Temporary <br />Cessation on the agenda of the next regular Board meeting and <br />give nottce to the operator, the county and any municipalities <br />as per Rule 2.23(1), (2) and (3). The Board, at said meeting <br />and in consultation with the operator and other Interested <br />parties, may take whatever action(s) it deems necessary and <br />are authorized Dy law, including but not necessarily limited <br />to: <br />- lOb - <br />
