- • ~ 1.6 <br />1.03(6) 1.6 Cessation and Termination <br />1.61 A permit granted pursuant to Rule 2 or 3 may continue in <br />effect as song as: <br />Art operator continues to engage 1n the extraction of minerals <br />and/or the mining operation and complies with the Drovisions <br />of the article (CRS, 34-32-101 et sue.). <br />1.62 A permit granted pursuant to Rule 2 or 3 may continue in <br />effect as long as: <br />Mineral reserves are shown by the operator to remain in the <br />mining operation. If the operator plans to, or does, <br />1.03(8) temporarily cease production or the mining operation (see <br />1.1(11} of the rules and regulations) for one hundred eighty <br />days (180) or more, he must file a notice thereof with the <br />Board stating the reasons for non-production or cessation of <br />the mining operation, a plan for resumption thereof, and the <br />measures taken to comply with reclamation and other necessary <br />ac tivltles related to the performance standards of Rule 6 as <br />established by the Board to maintain the mine in a <br />non-productnq or non-development state. The requirement of a <br />notice of temporary cessation shall not apply to operators who <br />resume the mining operation within one year and have Included <br />in their permit applications a statement that the affected <br />lands are to be used for less than one hundred eighty (180) <br />days per year. <br />(1) when tt is necessary to rule, the Board wilt consider <br />all testimony and facts related to a mining operation in its <br />determination as to whether or not temporary cessation has <br />occurred. The Board recognizes that not all of the factors <br />listed Delov must be satisfied and that no one factor fs <br />necessarily determinative, but that each determination will be <br />based on site-specific conditions. Factors to be included in <br />the determination include, but are not limited to: <br />(a) Amine will be considered for temporary cessation tf <br />(1) There are no personnel worktng <br />at the site far one hundred eighty (180) consecutive days. <br />(1i) There are only security personnel at the <br />site. <br />(iii) There are personnel other than security <br />people at the site, but they are engaged 1n activities <br />which can be described as maintenance or housekeeping, or <br />related activity. <br />- l0a - <br />
