Annual Certification
Rule Number 4, Section 4.05.9 (10) and (11)
1
1

1
1

1

1
She basis [or this certifiption is Rule Number 4, Section 4.05.9 (11) of the Regulations of the Colorado
Mined Land Reclamation Board for Coal Mining. References within this section of this certification quote
Rule Number 4 unless otherwise noted.
a) Eadstine end required monitorine procedures end instrumentation.
Inspections of the pond are required quarterly [Section 4.05.6(13)]. Quarterly inspections were made on
3/LSI94, 6/13194, 9/30/94, and 7 November 1994.
There is no existing or required instrumentation.
(b) The design depth and elevation of env Impounded waters at the time of the initial certification report or
the average and maximum depths and elevations of env impounded waters over the oast veer for the annual
certification reports.
The design maximum depth of impounded waters is 9 feet (between the bottom of [he pond and the invert
of the principal spillway). The design elevation of impounded waters is (the top of embankment as a datum
= 100') 97'. Based on quarterly inspection reports over the past year (3/LS/94, 623~J4, 9~30i94, and 7
November 1994), the average depth and elevation of impounded waters was 0.5' and 91.9', and the maximum
depth and elevation was 1.5' and 92.5', respectively.
c) Erdsting storage capacity of the dam or embankment.
The existing storage capacity of the dam is estimated to be approximately 2 acre feet (from the top of the
sediment to the invert of the principal spillway, Sedimentation Pond As-Built, 7-7-91, Rev. 1, F_xltibit 7,
Permit).
fd) Any fires occurring in the rnnstruction material up to the date of the initial certification or over the oast
year for the annual certification reports.
No fires were reported up to the date of the initial certification, and no indication of fires in the construction
materials of the dam was observed during the past year.
fe) Anv other aspect of the dam or embankment eRecting stability.
Burrowing by rodents (in conjunction with impounded water) has an adverse impact on the stability of the
dam. A lack of protective vegetation incurs an increased potential for erosion of the embankments.
Revegetation of bare areas and enhanced rodent control has been recommended.
Mined Land Reclamation Division letter, July 13, 1984
The basis for this section of this certification is Mined Land Reclamation Division letter, July 13, 1984, RE:
Professional Certification.
Chimney Rock Mine Pond #002 Inspection Report & Certification, 18 November 1994, Page 3 of 6
