A statement of the professional aualiflcations of the certifvine professional. <br />Mr. Walker was graduated from the Colorado School of Mines with a Professional Degree in Geologipl <br />' Engineering in 1959, and from the Missouri School of Mines at Ro0a with a Bachelor of Science Degree <br />Equivalent in Civil Engineering in 1964 and a Master of Srience Degree in Civil Engiueering (major in Soils <br />Engineering) in 1966. His pertinent experience includes construction of drainages structures, impoundments <br />for dredge spoils, and erosion control and wildlife water dams and ponds; teaching [earthwork (including <br />hydrology and drainage) design, methods of construction, construction management, and quality control <br />(including soil material testing)]; review and management of design and construction of dredge spoil <br />' containment structures (impoundments); and inspection of sedimentation darns for safety, stability, and <br />operational effectiveness. He is a registered Professional Engineer in the States of Colorado and Missouri. <br />A citation of the Rule twuirine the certification. <br />' The requirement for this certification is Rule Number 4, Section 4.05.9 (10) and (11) of the Regulations of <br />the Colorado Mined land Reclamation Board for Coal Mining. <br />' f~ A specific description of the subject of the certification. <br />' The subject of this certification is a sedimentation pond, and concerns items (a) through (e) presented above. <br />The pond is identified as Pond Number 002 in Permit Number C-81-012. This permit is to conduct a mining <br />operation known as the Chimney Rock Mine for the purpose of extracting coal, and was issued to Kaiser Steel <br />Resources. The Chimney Rock Mine (including the subject pond) is located in Archuleta County, State of <br />' Colorado, in Township 34 North, Range 4 West, New Mexico Prime Meridian, approximately 22 miles <br />southwest of Pagosa Springs, Colorado. <br />' This certification is limited to the maintenance and operation of the existing sedimentation pond, and is based <br />on the Sedimentation Pond As-Built, 7-7-91, Rev. 1, and other information found in Exhibit 7 of the Permit. <br />This certification does not extend to verification that the Sedimentation Pond As-Built, 7-7-91, Rev. 1 and <br />other information found in Exhibit 7 represents existing conditions in the field, nor that the structure was <br />' designed and/or built in compliance with Rules (Sections) 4.05.2 through 4.05.9 of Colorado Mined Land <br />Reclamation Division regulations (Permit, Section 2.05.3, Ponds, Impoundments and Diversions, page 2.05-2). <br />1 <br /> <br /> <br /> <br />!~ A statement of the actions taken in preperine the ceRification. <br />The following were reviewed: Rule Number 4, Section 4.05.9 (10) and (11) of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining; Mined Land Reclamation Division letter July 13, 1984; the <br />1993 annual certification and fourth quarterly inspection, and the 1st, 2nd and 3rd 1994 quarterly inspections <br />(325/94, 6/25/'94, 9/30/94, and 7 November 1994); permit documentation (including Sedimentation Pond As- <br />Built, Kaiser Steel, Chimney Rock, Pond No. 003, 5-30-91, Rev. 1; Drainage Control 1993 Reclamation Areas <br />Map 8, Greystone letter July 31, 1990, Re: Adequacy Review -Surface Water Control Plan, Chimney Rock <br />Mine (Permit No. C-81-023) and Greystone letter October 8, 1990, Re: Sedimentation Pond Certification <br />Chimney Rock Mine -Permit No. C-81-023); and the Dam Safety Manual (State Engineer's Office, June 3, <br />1983). Mr. Walker, accompanied by Mr. Dale Hockett, made a site visit and inspection on 7 November 1994. <br />Mr. Hockett, of E(k River Construction Company, is experienced in small earthen dam (pond) construction, <br />and made the fits[ three 1994 quarterly inspections of Pond 002. Prior to the 1994 inspections, Mr. Hockett <br />accompanied Mr. Walker on an inspection of the pond, and was instructed in inspection procedures to be <br />followed (referencing the Dam Safety Manual and standardized inspection report forms).
