' Banks and Gesso, LLC <br />11.0 Air Quality <br />' The operator will comply with all State air quality permitting requirements and will <br /> develop and implement a fugitive dust control plan for the property. The batch <br /> plant will be equipped with a dust collection baghouse. <br />' <br /> The sand and gravel deposit will be mostly wet and this will greatly inhibit fugitive <br /> dust. Haul and access roads will be watered to control dust and the processing <br /> plant will be equipped with spray bars at approximate locations. <br /> 12.0 Pesticide Contamination Issue <br /> <br /> Pesticides and herbicides used for agricultural applications were historically used <br /> and stored on the property. This creates the possibility for soil and ground water <br />' contamination on the property. The applicant is fully aware of this and has <br /> performed an investigsttion of the soil and groundwater. Extensive soil and <br /> groundwater testing has been performed on the property. Groundwater is not <br /> contaminated above State drinking water standards and surface soil <br /> contamination was found to be very localized in a small area near the buildings. <br /> Toxaphene (a pesticide) is believed to be the only chemical compound found in <br />' the soil that exceeds State standards. <br />The applicant /operator commits to appropriate remediation of any <br />contamination on the property in cooperation with CDPHE. Soil or ground water <br />that is contaminated above adopted State standards will not be disturbed until an <br />approved clean up plan is implemented. A Voluntary Cleanup Plan (VCUP) <br />application has been submitted to CDPHE. We wish to have the County process <br />the Conditional Use pt:rmit with the understanding that no disturbance of the <br />contaminated area of the property will take place until the VCUP is approved. A <br />copy of the VCUP application is included with this Conditional Use Permit <br />application. <br />' 13.0 Wetlands /Protected Species <br /> <br /> <br /> <br /> <br /> <br /> <br />A preliminary assessment has been performed for wetlands, Preble's Meadow <br />Jumping Mouse, and S•piranthes Diluvialis. Appendix 1, contains the results of <br />that assessment (as well as the results of a file search by the Colorado Natural <br />Heritage Program). No jurisdictional wetlands will be disturbed. <br />According to the preliminary assessment there does not appear to be any <br />Spiranthes Diluvialis habitat present on the property. Potential Preble's Meadow <br />Jumping Mouse habitat does exist however the applicant is seeking clearance <br />from the U.S. Fish and Wildlife Service that a trapping survey is not required. <br />Evidence of such clearance shall be forwarded to the County as soon as we <br />receive a response. <br />Speer Mining Resource Z; <br />Asphalt Specialties Company, Inc <br />99035 <br />July 24, 2000 <br />
