A*•r ua] Reeort <br />All SWMPs required under this pemrit are considered reports that shall be available to the public under Section 308 <br />the CWA. The owner or operator of a facility with stotmwater discharges covered by this permit shall make pl <br />available to members of the public upon request, unless the SWMP has been submitted to the Division However, the <br />permittee may claim any portion of a SWMP as confidential in accordance with 40 CFR part 2. <br />The pemrittee will be required to submit an-AnnuaLReport, covering January 1 through December3l of each year, on t}ie <br />overall compliance with the SWMP. The Annual Report shall contain, at a minimum <br />I) Name ofpemuttee, address, phone number, and permit certification number.. . <br />2). A report on the facility's overall compliance with the SWMP; including<a progress report on all remediation <br />activities. <br />3) A summary of each comprehensive stormwater facility inspection made, including date, findings, and action <br />'taken. <br />4)' Results and interpretation of any stormwater monitoring performed. <br />5) Certification language and signature by the perndttee. (See Part LD.E.2 of the permit) -' - <br />The report will be due to the Division on or before February 15 of the following yeaz. The exact due date for the <br />permittee's fast Annual Report will be listed in their permit rationale. Temrinatioa of Stormwater Permit Coveraee Requuemeat <br />1) Termination Criteria .r _ , <br />a) Reclamation Permit Release: When a site has been reclaimed in accordance with the Colorado Division <br />of Mineials and Geology (ACDMG@) requirements and the site has been released from State <br />reclamation requirements, the pemdttee may request termination of the stomrwater coverage under this <br />permit <br />2) Re9uest for Temmnatioa <br />When a site has been reclaimed in accordance with the CDMG requirements and the site has been released from <br />State reclamation requirements, the permittee may request temrination of stormwater coverage under this permit. <br />The Division will consider termination of stormwater coverage when: <br />a) the pemvttee has submitted a completed Inactivation Form as provided by the Division which <br />surnmarizes the work accomplished; <br />b All stormwater discharges to state waters associated with mining activities have ceased and the CDMG <br />perfomrance bond has been released; <br />d) The Division finds that Ore pemrittee has'-shown reasonable grounds consistent with the Federal and <br />State statutes and regulations for such termination; and <br />e) Fee requirements of Section 6. ] 6.0 of State Discharge Permit System Regulations have been met. <br />' Continued coverage may be required after reclamation or remediation has been completed if the Division has s~ <br />has reason to suspect that •We stormwater discharge may contnbute to a violation of a water quality standazd. <br />
