PARTI <br />Page No. 16 <br />Permit No : CO-0034142 <br />SPECIAL REQUIREMENTS (Continued) <br />4) Al] dischazgers must comply with the lawful requirements of counties, drainage districts and other state or local <br />.agencies regarding any discharges of stormwater to storm drain systems or other water cowses under their <br />jurisdiction. <br />c, SWMP Requirements <br />1) SWMP SubmittallReview/Changes: The Division reserves the right to request and review the plan, and to <br />requee additional measwes. to prevent and control pollution, as needed. Upon review of~the SWMP, the <br />Division may notify the permittee at any time that the plan does not meet one or more of the tninimutn. <br />requiremenu of this permit. After such notification, the pemvttee shall make changes to the plan.. TJnless <br />otherwise provided-by the Division, the perrnittee shall have 30 days after such notification to both make the <br />necessary changes to the plan and to implement them <br />TLe pemrittee shall amend the plan whenever there is a change in design, construction, operation, or maintenance <br />' which Las a significant effect on the potential for ilre dischazge of pollutants ro the waters of the State, or if the <br />SWMP proves to.be ineffective in achieving the general objectives of controlling pollutants in stormwater <br />- .discharges associated with n»ning activity. Amendments to the plan shall be summarized in the Annual Report. <br />d. Arohrbition of Non-storrrtwater Discharees <br />]) Except as provided in paragTapL b, below, al] dischazges authorized by the stonnwater portionrof this.perinit stall <br />be composed entirely of stormwater. Dischazges of water other than stomrwater must be addressed in a sepazate <br />CDPS permit issued for that discLarge. <br />2) Dischazges from the following sowces that aze combined with stormwater discharges associated with mining activity <br />may be. authorized the stormwater portion of this permit, provided that the non-stormwatet component of the <br />discharge is identified in the SWMP (see Part I.D.2.c of tLe permit): fire fighting activities, uncontaminated <br />compressor condensate, irrigation drainage, lawn watering,- av conditioner condensate, uncontaminated seeps and <br />springs; and foundation or footing drains where flows are not contaminated. <br />e. Facility ItrsneMions <br /> <br />Qrtalified persormel identified by the operator shall make a thorough inspection. of their stormwater management system, <br />at leasY.twice per year (in the spring and fall). These inspections must be documented and s„n,rnari>ed in tLe Annual <br />Report (see Part i.E. ] of the permit). <br />The inspections must include the following:. <br />1) Disturbed areas and areas used for material storage that are exposed to precipitation. stall be inspected for <br />evidence of, or the potential for, pollutants entering the drainage system Erosion and sediment control measwes <br />identified in the SWMP shall be observed to enswe drat they are operating correctly, <br />2) Based on the results of the inspection, the description of the potential pollutant sowces and the pollution <br />prevention and control measwes that are identified in the SWMP shall be revised as appropriate as soon as <br />pracAcalile afiei such inspection. Ri;4ised ctintroliireastires shall be implemented a timely manner, brit in no case <br />more than 90 calendar days after the inspection, unless otherwise provided by tLe Division. <br />3) The operztor shall keep a record of inspections, including the date of the inspection, major observations relating <br />to the implementation of the SWMP,-and actions taken in accordance witl! paragrapL 2), above. This record shat <br />be made available to the Division upon request and s,mmar;>ed iII the Annual Report. <br />f. SWMPAvailability <br />Upon request, the permittee shall submit a copy of the SWMP to the Division, the Colorado Division of Minerals an <br />Geology and EPA, and any local agency approving sediment and erosion plans or stormwater management plans, witLi <br />the periods specified in the request. <br />
