i ~ <br /> <br />Mr. Dick Gamewell <br />June 22, 1982 <br />Page - Two - <br />Colorado Department of Health - Permits Division <br />Comment No. 1 - "The 100 year flood plain mapping is still not accurate. <br />Don Simpson has discussed this matter with Dick Gamewell before and <br />has indicated that the mapping along the contour lines is not consistent. <br />Therefore, several of the structures at the mine may be in the flood <br />plain area that do not appear on the present map." <br />Response to Comment No. 1 - Since the date of this comment, Cotter filed <br />a revised flood plain analysis with the Radiation Control and Water <br />Quality Control Divisions of the Colorado Department of Health, The <br />Colorado Water Conservation Division and the Denver Urban Drainage and <br />Flood Control District. The latter two agencies reviewed Cotter's <br />flood plain analysis and maps carefully for the Jefferson County Com- <br />missioners. All elements of the analysis and flood protection design <br />were agreed to by these two agencies. In addition, please note that all <br />existing and proposed structures to be regulated by the radioactive <br />materials license will be protected from the flood plain. <br />Comment No. 2 - "The emergency response procedure for a loss of the <br />volume of liquid in the thickener tank should include a containment <br />area capable of handling the entire volume. If the leak from the tank <br />occurs at a rate greater than what the pumps can handle the spill might <br />enter Ralston Creek. Also, if either pump is not functioning properly <br />the liquid could enter the Creek." <br />Response to Comment No. 2 - The emergency response procedure described <br />in Section 5.3 of the application was developed for the purpose of <br />precluding the contents of the ore sorter thickener tank from reaching <br />Ralston Creek in the event of a spill. <br />Comment No. 3 - "The License contains a stipulation for collection and <br />containment of surface runoff at the ore crusher-sorter and water treat- <br />ment plant but not at the waste dump areas. Why haven't these areas <br />been included?" <br />Response to Comment No. 3 - The waste dump areas fall within the juris- <br />diction of the Colorado Division of Mined Land Reclamation. Referring <br />to the MLRB permit for this site (MLRB File No. 77-300, Cotter is <br />required by that permit to construct a runoff control ditch above the <br />waste dump during the relcamation of the mine site. In addition, a soil <br />analysis was conducted by Tom Colbert and Associates using soil samples <br />collected between the'•wa' ump and Ralston Creek in October, 198. <br />The chemical analysis of these samples indicated no evidence of radio- <br />nuclide runoff or infiltration into these soils as a result of precipi- <br />tation runoff from the waste dump. <br />
