<br />GC-25.0 TITLE TO MATERIALS FOUND <br />Except as otherwise provided, the title and right to use or dispose of all materials discovered and <br />developed in the WORK by SUBCONTRACTOR aze expressly reserved for the CONTRACTOR <br />and COMPANY. Neither SUBCONTRACTOR nor any of its employees shall have any right, <br />title or interest in or to any part thereof. <br />GC-26.0 DELTi~ERY. UNLOADING AND STORAGE OF COMPANY-FURNISHED ITEMS <br />' Upon receipt of CONTRACTOR or COMPANY-furnished items, CONTRACTOR and <br />SUBCONTRACTOR shall make a joint inspection. SUBCONTRACTOR shall provide a written <br />' report to CONTRACTOR of any damage found. Except for latent damage, failure to report <br />damage shall constitute acceptance of responsibility for same by SUBCONTRACTOR. <br />' All CONTRACTOR or COMPANY-furnished items shall be received, unloaded, stored, if <br />required, removed from storage and installed by SUBCONTRACTOR unless otherwise <br />' specified. SUBCONTRACTOR shall have complete care, custody, and control until FINAL <br />ACCEPTANCE by CONTRACTOR. Care and protection to prevent degradation or damage <br />during handling, storage and installation shall be the responsibility of the SUBCONTRACTOR. <br />' SUBCONTRACTOR shall maintain complete and accurate records of all permanent materials <br />and plant equipment received, stored and issued for use. Records shall be available for <br />1 CONTRACTOR'S review whenever required. <br />GC-27.0 DELAYS AND FORCE MAIEURE <br />' SUBCONTRACTOR shall advise CONTRACTOR in writing within 3 working days after <br />experiencing a delay, and thereafter continue to advise CONTRACTOR concerning such delay. <br />Without limitation, SUBCONTRACTOR shall not be excused from delay due to any act or <br />omission of SUBCONTRACTOR or which is normally incidental to the WORK. <br />' GC-28.0 LOSS OR DAMAGE BY ACTI ONS OF OTHERS OR UPON OTHERS <br /> SUBCONTRACTOR shall have no chum against CONTRACTOR or COMPANY and <br />' CONTRACTOR or COMPANY shall not be liable for damage or loss by reasons of delay, <br />default or act of omission of other contractors, subcontractors, or their agents or employees, but <br />nothing herein contained shall limit any righu of SUBCONTRACTOR to recover therefore <br />against such other contractors, subcontractors, or their agents or employees. If <br />SUBCONTRACTOR, by any default, negligence or misconduct on its part, damages any other <br />contractor or subcontractor it hereby agrees to be directly responsible to such other contractor <br />or subcontractor for any such damage and to hold COMPANY and CONTRACTOR harmless <br />from all such damages. <br />' GC-29.0 WAIVER OF BREACH <br />None of the conditions of the CONTRACT shall be considered waived by CONTRACTOR <br />' unless such waiver is given in writing. No such waiver shall be a waiver of any past or future <br />' 3-10 <br />
