<br />that the Bidder is aware of the conditions to be encountered at the site and of the requirements <br />for performing the WORK. <br />I~ MODIFICATION AND WITHDRAWAL OF PROPOSAL <br />Bidder may withdraw its bid up to the time of bid. Following withdrawal, Bidder may submit <br />a new bid, as long as it is received prior to the time of bid stipulated in Section 1.3. <br />Telegraphic bids will not be considered, but modifications by telegraph or in writing will be <br />considered if received prior to the time set for opening. Telephone and/or oral requests to <br />modify a bid will not be considered. Bids shall be firm for 90 calendaz days after the bid <br />closing date. Negligence or mistakes on the part of the Bidder in preparing its bid confers no <br />right of withdrawal after the bid closing time. <br />I-5 CONTRACT AWARD <br />CONTRACT will be awazded to the Bidder whose bid is most advantageous to CONTRACTOR <br />with all factors considered. CONTRACTOR reserves the right upon its sole discretion and <br />judgment, to reject any or all bids and to waive any irregularity in the bids received. Within <br />10 calendaz days of receipt of CONTRACT for execution, the successful Bidder shall execute <br />the CONTRACT and provide the required certificate of insurance, and return these executed <br />documents to the CONTRACTOR for review and processing. The successful Bidder shall be <br />referred to as the SUBCONTRACTOR in the CONTRACT DOCUMENTS. Failure by Bidder <br />to properly execute the CONTRACT and provide the required certification as specified shall be <br />considered a breach of contract by Bidder.
