1985, ten years ago.
The Statement of Basis for Rule 3.1.7 speaks to
addressing activities or operations that are
currently ongoing or planned that may require
investigation or setting requirements for
protecting groundwater. And, I believe if we have
any activities out there, we probably could apply
anything to that that would bring about any sort
of a change in the potential to impact
groundwater. Also, we believe that the
evidentiary burden, under the Section 3.1.7 of the
Rules requiring the groundwater characterization
studies, has not been met. And, also, we believe
that requiring an extensive or costly groundwater
study at this site is not justified or authorized
by law and would subject us to an excessive
economic burden; particularly, in light of the
fact of what the current status of the operation.
That's all I have, at this point. I guess you
want to get...I don't know how you want to work
this...if you want to ask some questions later,
after Allen has had an opportunity or...
COOLEY: Does anybody on the Board have a question of Mr.
Cox while he' s here. ..about his presentation?
12
