Okay. Now, you have a response, Allen, for the
Division?
SORENSON: Yeah. I think, maybe procedurally, we could...
the Division could give their presentation and
then if there's any questions for either party...
And, I think Homestake's request for Declaratory
Order is written in the form that they're
requesting it in. So, that maybe can be restated
or you have it in writing before you, too. But,
the Division's presentation will be, I think,
relatively brief. It's our view that it's
explicit in both the applicable statutes and
regulations, as well as implicit in the Board's
approval of the groundwater regulations and the
Statement of Basis and Purpose, that the Division
not only has the authority to implement the
groundwater regulations at the Bulldog and similar
sites, but is actually required by statute and
regulations to facilitate that implementation.
And, as such, the Division's memorandum that was
sent to the Board in the Board mailing focused
more on the subject ~of 'is there a reasonable
potential at this site to suspect that groundwater
contamination has occurred or may be occurring at
the site'. And, primarily what we wanted to give
input to the Board on in that view was given in
our memorandum that was sent to in the Board
13
