<br />Okay. Now, you have a response, Allen, for the <br />Division? <br />SORENSON: Yeah. I think, maybe procedurally, we could... <br />the Division could give their presentation and <br />then if there's any questions for either party... <br />And, I think Homestake's request for Declaratory <br />Order is written in the form that they're <br />requesting it in. So, that maybe can be restated <br />or you have it in writing before you, too. But, <br />the Division's presentation will be, I think, <br />relatively brief. It's our view that it's <br />explicit in both the applicable statutes and <br />regulations, as well as implicit in the Board's <br />approval of the groundwater regulations and the <br />Statement of Basis and Purpose, that the Division <br />not only has the authority to implement the <br />groundwater regulations at the Bulldog and similar <br />sites, but is actually required by statute and <br />regulations to facilitate that implementation. <br />And, as such, the Division's memorandum that was <br />sent to the Board in the Board mailing focused <br />more on the subject ~of 'is there a reasonable <br />potential at this site to suspect that groundwater <br />contamination has occurred or may be occurring at <br />the site'. And, primarily what we wanted to give <br />input to the Board on in that view was given in <br />our memorandum that was sent to in the Board <br />13 <br />
