Exhibit "G"
WATER INFORMATION
The additional area proposed to be added to the permit
will not change the water requirements of the operation or
the source of that water. The water rights requested from
the District Court, Water Division No. 5, at the time of the
original permit application were conditionally granted on
October 7, 1979. Those water rights have been put to bene-
ficial use, and an application to make them absolute was
filed in July of 1983. Statements of opposition have been
filed on behalf of The Eagle River 1978 Trust, The Brush
Creek and Eagle River Company, and Eagle Ranch, Inc. , all of
which entities are believed to be made up of substantially
the same principals and to include Chester Goldman. The
allegations made in opposition to the Application are
believed by the Operator and his attorneys to be without
merit, and it is anticipated that the Water Court will
ultimately grant the Operator' s Application.
