COVERAGE UNDER THIS PERMIT

general permit or an individual permit is required, instead of coverage under this general permit.)
b. Automatic Coverage: If the applicant does not receive a request for additionl information or a notification
of denial from the Division dated within thirty days of the receipt of the application by the Division,
authorisation to discharge in accor~danoe with the condition of this permit shall be dxmed granted.
c. Individual Permit Required: If, afrer evaluation of the application (or additional information, such as the
SWMP), it is fond that this general permit is not applicable to the operation, then the application will be
processed as ane for m imiividnal permit The applicant will be notified of the Division's decision to deny
certification under this general permit For an individual permit, additional information may be requested, and
180 days will be requited to process the applicstion and issue the permit. Temporary coverage under this
general permit will be allowed until fhe individual permit goes into effxt
d. Geneal vs. Individual Pewit Coverage: Any owner or operator authorised by this permit may request to
be excluded from the coverage of this permit by applying for as individual CDPS permit. The owner or
operator shall submit oo individual application to the Division, with reasons supporting the request.
e. Permit Certifications: The individual certification prepared for each applicant will indicate whether Part I.B
of the permit which must be followed by that applicant. Part I.C must be followed by all pertnittees unless
exempted as outlined in Section III.C of the Ratiomle. (In the absence of such indication from the Division,
the permittee will be mponsible for determining sad then complying with the applicable sxtion in Part I.)
In addilioa, all oemittees will be regtdred to comply with Part I, subparts A, D, E and F, and all of
Part II of the permit.
Permit Exoiration Date
Authorvation to discharge under this general permit shall commence oa October 1, 1992, and shall expire on
September 30, 1997. The Division must evaluate and reissue this general permit once every five years, and must
also recertify the applicant's authority to discharge under the general permit at such time. Therefore, any permittee
desiring continued coverage under the general permit must reapply by March 31, 1997. The Division will determine
if the applicant may continue to operate under the terms of the general permit.
An individual permit will be required for say facility sot teauthorved to discharge under the reissued general permit.
For facilities wishing to r i„er. a„rt,,,.;,ne;~ ~m tyn new permit, provision of Part II.B.S.d will be applicable.
Inactivation of Certifimtion
The permittce may request inactivation of their certification under this permit, once the site has hem fully released
from their reclamation bond requirements by the Colorado Division of Mining and Geology (CDMG). See Pan
II.B.S.d of the permit.
EFFLUENT LIMITATIONS AND CONDTITONS -PROCESS WATER DLSCHARGE
