(Notification of denial shall be by letter, in cases where coverage under an alternate <br />general permit or an individual permit is required, instead of coverage under this general permit.) <br />b. Automatic Coverage: If the applicant does not receive a request for additionl information or a notification <br />of denial from the Division dated within thirty days of the receipt of the application by the Division, <br />authorisation to discharge in accor~danoe with the condition of this permit shall be dxmed granted. <br />c. Individual Permit Required: If, afrer evaluation of the application (or additional information, such as the <br />SWMP), it is fond that this general permit is not applicable to the operation, then the application will be <br />processed as ane for m imiividnal permit The applicant will be notified of the Division's decision to deny <br />certification under this general permit For an individual permit, additional information may be requested, and <br />180 days will be requited to process the applicstion and issue the permit. Temporary coverage under this <br />general permit will be allowed until fhe individual permit goes into effxt <br />d. Geneal vs. Individual Pewit Coverage: Any owner or operator authorised by this permit may request to <br />be excluded from the coverage of this permit by applying for as individual CDPS permit. The owner or <br />operator shall submit oo individual application to the Division, with reasons supporting the request. <br />e. Permit Certifications: The individual certification prepared for each applicant will indicate whether Part I.B <br />of the permit which must be followed by that applicant. Part I.C must be followed by all pertnittees unless <br />exempted as outlined in Section III.C of the Ratiomle. (In the absence of such indication from the Division, <br />the permittee will be mponsible for determining sad then complying with the applicable sxtion in Part I.) <br />In addilioa, all oemittees will be regtdred to comply with Part I, subparts A, D, E and F, and all of <br />Part II of the permit. <br />Permit Exoiration Date <br />Authorvation to discharge under this general permit shall commence oa October 1, 1992, and shall expire on <br />September 30, 1997. The Division must evaluate and reissue this general permit once every five years, and must <br />also recertify the applicant's authority to discharge under the general permit at such time. Therefore, any permittee <br />desiring continued coverage under the general permit must reapply by March 31, 1997. The Division will determine <br />if the applicant may continue to operate under the terms of the general permit. <br />An individual permit will be required for say facility sot teauthorved to discharge under the reissued general permit. <br />For facilities wishing to r i„er. a„rt,,,.;,ne;~ ~m tyn new permit, provision of Part II.B.S.d will be applicable. <br />Inactivation of Certifimtion <br />The permittce may request inactivation of their certification under this permit, once the site has hem fully released <br />from their reclamation bond requirements by the Colorado Division of Mining and Geology (CDMG). See Pan <br />II.B.S.d of the permit. <br />EFFLUENT LIMITATIONS AND CONDTITONS -PROCESS WATER DLSCHARGE <br />is section (I.B) only applies to facilities with a discharge of process water.) <br />1.
