<br />I• <br />• <br />.\ <br /> <br />casualties not attributable to American Fuels oc by <br />reason of any law, order, rule, or regulation <br />issued by the United States Government or any <br />instrumentality thereof or any other duly con- <br />stituted governmental authority; provided, however, <br />that in the event there are circumstances beyond <br />the control of American Fuels as enumerated above, <br />including the occurrence of faults or the lack of <br />coal in paying quantities, which prevents it from <br />mining coal, then, at American Fuels' option this <br />lease may be terminated upon thirty (30) days' <br />written notice given to C&U by Certified Mail, <br />Return Receipt Requested; in which event, American <br />Fuels shall pay CSU only the amount of royalty for <br />coal produced as provided for in Paragraph 2 hereof <br />which shall be deemed to have accrued up to the <br />date of termination. <br />b) In the event American Fuels fails to pay to C&U the <br />production royalty when due, or if there is filed a <br />petition for adjudication of American Fuels as a <br />bankrupt or legal proceedings are instituted in <br />receivership, reorganization or liquidation, or the <br />making of an assignment for the benefit of credi- <br />tors or if American Fuels fails to comply with any <br />teem hereof, C&U shall give American Fuels written <br />notice by Certified Mail, Return Receipt requested, <br />of such alleged failure or default and if American <br />Fuels shall not, within thirty (3Q) days after <br />actual receipt of such notice, have made payment of <br />- ---- --any amounts due or-shall._not have entered upon the <br />correction of any other actual defaults, C&U, may, <br />at its option, terminate this lease by notifying <br />American Fuels of such election in the manner <br />aforesaid.
