MINING OPERATIONS American Fuels hereby covenants and agrees to conduct its operations in a good and workmanlike manner in order to recover as much of the merchantable coal available in an area located between the coal outcrop line and a point where the overburden reaches an over- all height of eighty (80) feet, in keeping with good mining practice, and to conduct its operations in such a manner as to prevent the loss of merchantable coal. American Fuels hereby covenants and agrees that it will lay out its workings in the demised premises in a man- ner in keeping with current good mining practices, and further agrees that it will use its best efforts in good faith to comply with instructions as requested by C&U's Director of Subsidiaries pertaining to develop- ment of the surface workings for protection of creeks, highways, ditches, canals, tunnels, railroads and other surface improvements and other matters in accordance with proper and safe mining practice. American Fuels also agrees to pay the aforementioned royalty rate on the computed tonnage coal which has been lost due to improper mining practice on its part. 7. TERMINATION a) It is mutually understood and agreed that in the event that American Fuels should discontinue mining operations for a period of six (6) consecutive months, C&U at its option may thereupon cancel this lease upon giving thirty (30) days' written notice thereof to American Fuels by Certified Mail, Return Receipt Requested, addressed to Lessee at the address shown herein, unless said discontinuance of operations by American Fuels be occasioned by strikes, accidents, damage to or destruction of plant, inability of common carrier to make trans- portation, fire, flood, or acts of God or other -7- ~~ q
