-..I Fuels further agrees that it will not institute any action or claim arising from past operation of any por- tion of C&U's idle mines no matter where located. INSURANCE American Fuels shall secure before commencing any activity on the demised premises, and shall maintain during the term of this Agreement: (a) One Million Dollars ($1,000,000) combined single limit Comprehen- sive General Liability and Property Damage Insurance Policy; (b) Statutory Workmen's Compensation and Occu- pational Disease Disability Insurance; (c) Employer's Liability Insurance with limits of $100,000 each occur- rence; and (d) Automobile Insurance with Public Lia- bility limits of $100/300,000 and Property Damage limits of $50,000 each occurrence. Before commencing operations, American Fuels shall also furnish to C&U evidence of such insurance coverage in the form of the insuring company's original Certificates of Insurance, together with evidence that the insurance carrier has assumed the liability of American Fuels hereunder and waives any of the terms, conditions or exclusions con- tained in the insurance contract which might affect or detract from the coverage for assumed liability of the named insured either by furnishing to C&U a properly executed "Assumption of Contractual Liability` endorse- ment, or by a Certificate of Contractual Liability insurance coverage endorsed to provide that the insur- ance carrier shall provide full covezage for liability assumed by the named insured under its described agree- ment with C&U and to any obligation for which the insured or his insurance company may be held liable under any Workmen's Compensation, Occupational Disease, Unemployment Compensation or Disability benefit laws, and specifically including the Federal Coal Mine Health and Safety Act of 1969, as amended, or under any sim- ilar law.
