If the mining will not proceed in some type of phased manner the financial warranty will be <br />calculated based on the maximum disturbance at the site. Based on the lack of information <br />provided so far on affected lands and phasing the financial warranty would be calculated on 98 <br />acres of disturbance. A thorough description of mine phasing is needed to so that the Division can <br />calculate an accurate bond. <br />In addition Rule 3.1.3 states "All reclamation shall be carried to completion by the Operator with <br />all reasonable diligence, and each phase of reclamation shall be completed within five (5) years <br />from the date the Operator informs the Boazd or Office that such phase has commenced, unless <br />extended by the Board or Office. The 5-yeaz period may be applied separately to each phase as it <br />is commenced throughout the life of the mine". The information provided so far is insufficient for <br />the Division to ensure compliance with this rule. The Applicant is encouraged to develop a phased <br />mining plan in order to comply with this rule. <br />5. Please provide the nature of the stratum immediately beneath the material to be mined. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />1. A soil test pit was dug along one of the ridges during the pre-operational inspection. That test <br />hole suggested there is at least 8 inches of topsoil at the site. The one profile provided to the <br />Division indicates that the A horizon is between 6 and 16 inches deep. Given these findings <br />the Division recommends that the applicant salvage at least 8 to 16 inches of topsoil. <br />2. The schedule provided for reclamation implementation does not appeaz to meet the <br />requirements of Rule 6.4.5(2)(e). Please provide a plan or schedule indicating how and when <br />reclamation will be implemented, including: <br />a. An estimate of the periods of time that will be required for the various stages or <br />phases of reclamation. <br />b. A description of the size and location of each area to be reclaimed during each phase. <br />c. An outline of the sequence in which each stage or phase of reclamation will be carried <br />out. <br />This information can be provided in conjunction with the information required under item <br />seven in the mining plan section. <br />3. Please specify maximum post-mining anticipated slope gradient or expected ranges thereof. <br />4. The attached NRCS Seeding Plan indicates that mulch and fertilizer will be applied, and that <br />seeds will be drilled, but the section on seeding states that mulch and fertilizer maybe used, <br />and seeding may be by drilled or broadcast. Please clarify. If the Applicant chooses to wait <br />until reclamation to determine if mulch or fertilizer are to be applied, please describe what <br />methods will be used to determine if they are needed. Also please specify mulch and fertilizer <br />types, mixtures, quantities of, and time of application. <br />5. A noxious weed species was observed onsite (Tamarisk). The Applicant will need to develop <br />a weed control plan for the control of these weeds and submit it as part of the application. <br />6.4.6 EXHBIT F -Reclamation Plan Mao <br />1. The map submitted does not meet the requirements described in Rule 6.4.6. Please provide at a <br />minimum the following items: <br />a. The expected physical appearance of the azea of the affected land, correlated to the <br />proposed mining and reclamation timetables. <br />
