e. A possible hay bam off the south west corner of the property. <br />8. There are two pre-permit mining azeas in the proposed site. Please describe the extent and location <br />of these sites. <br />9. There is an approximate 3000-foot semi-improved access road, and another approximate 5000 foot <br />long semi-improved road along the length of the proposed site, neither of which are included in the <br />proposed pemrit azea. According to the definition of affected lands (Rule 1.1(3)), "Affected land <br />shall not include off-site roads which existed prior to the date on which notice was given or pemut <br />application was made to the office and which were constructed for purposes unrelated to the <br />proposed mining operation and which will not be substantially upgraded to support the mining <br />operation". Will these roads be upgraded as part of this operation? If so please specify what those <br />upgmdes will be and whether they constitute substantial upgrades, If there aze substantial <br />upgrades to the access roads, they may need to be included in the permit area. This could increase <br />the acreage and change the scope of the proposed mine. These changes may require the applicant <br />to resubmit the application and start over the public and agency notification process. <br />6.4.4 EXHIBIT D - Mining Plan <br />1. There are already two water diversions structures on site. How do these structures fit into the <br />mining plan? What actions will the Applicant take to ensure that these structures are not <br />damaged? What actions will the Applicant take if these structures are damaged? (Also see the <br />section 6.4.19 below) <br />2. There are possibly as many as five ephemeral watercourses in the draws that run through the site <br />See Section 6.4.7 item #1). Provide a description of how these watercourses will be dealt with <br />during mining. Specifically, if protection of these draws and associated watercourses is needed, <br />how will the Applicant avoid these areas during mining? Provide details on any practices and <br />erosion control structures that will be needed to avoid impacting these watercourses? <br />3. Please be more specific about the type, extent, location, and timing for the erosion control features <br />listed in section C. Will any water quality or storm water detention ponds or other structural <br />measures be required? Please provide a description of any structures or practices that will be <br />required by the Water Quality Control Division stonnwater permit. (Also see comments in sectior <br />6.4.7, item 5). <br />In your May 6, 2005 NRCS attachment the Conservationist states that water erosion will be a <br />problem. He further states that water control will be an issue, and that flooding from the site <br />during rain events will cause damage [o cropland. Please comment on the NRCS letter. <br />Based on the Conservationists findings, a more thorough plan than the one provided appears to be <br />needed for this site. This may include stormwater sediment control ponds and associated <br />stormwater conveniences, berms and other structural measures as well as minimizing the size of <br />the mine disturbance at any one time (mine phasing). This site may also need a stormwater permit. <br />Please review the proposed stormwater plan and make modifications to the mining and <br />reclamation plans to ensure that that is not any offsite damage from stormwater flows (Rule 3.1.6). <br />4. Per Rule 6.4.4(e) please provide the following information. <br />a. An estimate of the periods of time which will be required for the various stages or phases <br />of the operation; <br />b. A description of the size and location of each area to be worked during each phase; and <br />c. An outlining the sequence in which each stage or phase of the operation will be carried <br />out. <br />
